Since that time he has conferred with members and leaders of the Tr regulars, from whom he says h learned that they considered that the present Provisional Government of Ireland Js not entitied to the property im this country and should not be per mitted to turn it over for the bencfit of the Irish Free State. In July, Smiddy was directed by Collins to ascertain what funds were deposited here. Thereupon he talked with Healy, a clerk !n actual charge of the New York office of the all Smiddy said taht Healy, although fully aware of his credentials as a yepresentative of Collins, refused to recognize any right he might have and to give any information as to the funds here. Smiddy also says that Henty's pre- decessor, Gilbert E. Ward, who is one of the defendants, was discharged from the New York office because he refused to give information sought and sympathized with the Irregulars. He says Healy since that timo in the conduct of the office has continued to manifest sympathy with the Ir- regulars and has given information either reluctantly or has refused to give any information at all relating to the Irish funds. Estimates as to the total amount of money collected, in this country jargely through fhe. activity of De Valera and his Heutenants have var- ied, the highest estimates placing the amount at $7,000,000, For a long time the money was deposited in various hanks in De Valera’s name, but was supposed to be held in trust by a com- initteo of three, consisting of De Va- jera, Bishop Fogarty and James O'Mara, for the Irish Parliament or Pail Eireann, When the Irish peace treaty was signed the Free State Irish held that De Valera should no longer have custody of the funds in this country and that he should be de- prived of the right to make further collections. The point was a matter ef discussion and argument~in Irish circles for a long time. Notwithstand- ing protests, it is asserted, at least. $250,000 and possibly much more was withdrawn from the fund early in this year. ‘The plaintiffs are given ten days to effect service on the respondents per- sonally and thirty days in which to effect service by publication, O'Mara, De Valera and Ward are not in this country at present and hence must be served by publication, In his decision granting the injunc- tion Justice Burr said in part: “It appearing to my satisfaction by ihe complaint herein, verified Aug. 11, 4922, that the plaintiffs demand and are entitled to a judgment against the defendants, restraining the commission of the acts herein- after enjoined on the ground that such acts in repudiation and tn violation of the rights of the plain- tiff, Irish Free State as beneficiary of the trust funds and property dereribed rn the complaint; that the commis- sion of the sald acts during the ency of the action would prod Injury to the plaintiffs, and that such commission on the part of the defendants Is threatened and rea- mably to be apprehenc and it ippearing by said complaint and aM. davite that the defendants during the pendency of this action are doing or procuring or suffering to be done, and threaten or are about to do the acts hereinafter enjoined, in violation of the rights of the plaintiffs respecting the subject of the action and tending to render the judgment ineffectual by misapplying and withholding the sald fand et forth In the complaint."* The Court then orders the Harri- National Bank anty Safe Deposit Company, Central Union Company and a Deposit Company from permitting person to hav to or withdraw property from the snfe deposit boxes until the further order of the court, reparable nd property a man Justice Burr further orders that the defendant, Matthew Garth Healy be enjoined and restrained from with- drawing or taking possession of any of the funds or property mentioned, or any funds or property received under the trust agrecment mentioned In the complaint, and from remaining fur- thor in charge of the office at No. 411 Avenue, and from dealing with noving any pers and records ein, and from interfering with the taking charge of this office by /the Irish Free State through the Ptovi- sional Government of Ireland or the Dail eann or the representative of cither of them, unUl the further order of the court. Mil- ler states that at that time he would rather have cast his lot with the sea- plane as in his opinion it more seaworthy than the schooner it- self, but without power he was un- able to proceed, so had no other choice than to take his chances with the lit- tle schooner. “Cupt. Miller reports that on final inspection of his motor, he found that one of the driving gears had broken, crippling the {gnition system, which caused the motor to stop. “Riding to the sea anchor,"’ the statement continues, “the plane rode ightly on the waves without taking any water and drifting with the wind Rejects for an SA 1321 pairs. 943 pairs. 1236 pairs. 1604 pairs.
