Judge Hebbard will have some im- portant points to determine in regard to the rights claimed under the law by labor unions when he hears the mo- tion to be made for the modification of the temporary restraining order grant- ed in the case of Goldberg, Bowen & Co. against the Stablemen’s Union. Notice of the motion was filed yes- terday by Henry B. Lister, attorney for the union, who contends that the de- fendants have the right Yo interfere with or coerce patrons or employes in all ways; that the law recognises as “Gamnum sine injuria,” or {injury without damages, and under the same construction the right to interfere with business. It is contended also that the unions have the right under the constitution freely to speak and pub- lish their opinions by banners, pickets, eirculars or otherwise.
