The United States circuit court of appeals has up- held the decision of the United States district court in North Dgzkota in the so-called Townley bank- ruptcy case. In this suit Mr. Town- ley’s personal creditors, who claimed he owed them money as a result of his farming operations in western North Dakota several years before the Ledgue was organized, -attempted to seize League property and property of co-operative newspapers, stores and banks owned by League.farmers. The case was practically turned over by Mr. Townley’s personal creditors to the League opposition, which has used the case for years as propaganda -against the League. It was charged in court that Mr. Townley was rich; that he was personally profiting to the extent of hundreds of thousands of dollars, or even millions, through his connection with the League. It was charged he had put by so much money, gotten by graft wrung from the farm- ers, that he could pay all the money which his creditors claimed he owed them as a result of his now famous farm failure, which occurred prior to the organization of the League. In deciding the case, Judge Amidon of the United States district court in North Dakota found that Mr. Townley was a poor man; that he had drawn only his modest: salary and legitimate traveling expenses while working for the League; that he had not made any personal profit out of the League or out of various co-operative farmers’ enterprises and ventures connected with the League, such as League pub- lications; that League books and ac- counts were accurately and honestly kept; that the charges of graft against Mr. Townley were false; that Mr. Townley’s stewardship of League af- fairs had been honest and fair. Several years before he or any one else' even thought about anything like the Nonpartisan league, the Townleys bought and leased large tracts of vir- gin land in Golden Valley county, N. D., and went into flax farming on a large scale by machinery. - Their suc- cess the first year encouraged them to increase their land holdings and buy more machinery, but an early frost cut down their harvest and the bottom fell out of the flax market, through manip- ulations by speculators, completing the financial ruin of the brothers. Their creditors seized all their land and ma- chinery, and even after that claimed that the Townleys owed them some- thing like $70,000. ‘ Mr. Townley, who was a few years later to become famous as the organ- izer of the present great farmers’ movement, left the farm with his wife with a small grip full of personal be- longings—the creditors got all the rest.
