EXCURSION OF COMPANY F, WASHINGTON GREYS. ‘This well disciplined company, under the command o Captain Leander Buck, have completed thelr arrangements for their trip to Niegara, Montreal and Boston. They wit lesve this city on the let of August, by the 6A. M. traio on the New York and Erie Raliroad, arriving at Buffalo at 9:30 P. M., where they will be received by Company 0, Seventy fourth regiment, Captain Wm, F. Rogers, and es: corted to the American otel. On Lucaday the company ‘will leave Buffalo inthe 1 P.M train for Niagara Fails, accompanied by their escort, resobiog there at 2 P. M. ‘They will quarter at the Cataract House. We bear incidentally, though upon good authority, that the valicity of this inptrument will hecome the subject of judicial inquiry, and that messures.will be taken to set uside. It ie said that bis. The young gentiemsn in whose name this trust is execu ted ir the son of the subscribing witness, at whose instance Mrs. Dudiey says she affixed to it her signature, under the svpposition that she was executing a power of attoraey autborizing the adjustment of some dificulties growing out of the Dudley Observatory controversy. ‘The fect that such an instrument should bave been ob- tained without the knowledge of her basiness agent, Mr. Netz, in whom Mrs. Ducley bas always reposed tne most imphicit confidence; that it was not executed and acknow- ieged by her before a competent persom in Albany, but ‘Toronto. After remaiping ‘here three or four hours they will proceed to Montreal via Ogdensburg, reaching wat place at about 7% P.M. At this place they will quarter fat the Montreal House. On Friday morning they depart by railroad for Boston via Rouse’s Point, Montpelier, Con: cord and Lowell, arriving there at nigtt, where they will be received by Companies B and D cf the Second regi ment, Captains Edward Pear! and Thos. L. D. Perktos, At thie place they will quarter at the American House, and on Saturday evening they will return home via the Fall River route. Io March last abe became, as it was, her own executor, acticiputiog het decease, and giving to many of the persons named ia the will immediate poseession of the property. The epecific sams meptioned absorbed about $300,000 of tho estate. As the bulk of the remainder was to bo equally ci- yided among a number of persons, that portion of the will remains to be executed after ber decease. ‘The amount disposed of by this deed of truat is about $260,000. If the deed should be declared valid, of course ‘there will be no property subject to the operation of the unfulfilled provisions of the will. ‘The nawe of Dudley seems destined to perpetuation in the records of the judiciary,as well as in the politica! and ecientific world. Nichcl vs. Ber. nard Ulman.—This was an action brought by plaintiffs for the loan of certain chandeliers furnished for the use of the ball for the benefit of the Mount Vernon Associa- tion, held at the Academy of Music on the 29th of Dacem- ber, 1858. The evidenbe went toshow that the chando. Hers, globes, &o., were ordered by Dion Bourcicault, the dramatic autoor and artist, and that they wore charged on the books of plaintiffe against him ; it alzo appeared that neither Mr. Uliman, the defendant, nor Mr, Palmer, his egent, Knew anything about the things having been ordered until the orders had been already given. It fur. ther peared by the evidence that the ball given in aid sociation was a failure, and did not pay expenser, jat Mr. Ullman panded over tothe fund $1 000, which was $600 more than was coming to the associatioa after paying the necessary expenses The question for the C.urt to determine, under this state of facts, was who was |inble for the rent of the chandeliers. Mr. Galbraith, on the part of the defendent, moved for judgment in bis favor, on the ground that the evidence conclusively ebowed tbat tho chandeliers had boen ordered by Mr. Bourcicault without the knowledge of Mr, Ullman (who was at the time absent from the city) or of bis agent; and algo on the ground that the indebtedness was charged on the books of the plaintiff against Mr. Bourcicau!t, woo was not in any way authorised by tho cefendant to contract the debt. The Court took the pavers, and in the afternoon ren- dered judgment for the defendant. ACTION FOR ASSAULT AND BATTERY COMMITTED IN A FOREIGN PORT.
