ne are The Sunday Lew In Philadelphia. MASS MBBTING OF CITIZENS IN FAVOR OF RUNNIN) RAILROAD CARS ON SUNDAY. From the Philadeiphis Ledger, July 25.) If the acvocates of @ restrictive Sunday law, iu - re feut action sgainst Sunday travelling, desired to bring ‘that law to the test of public opinion, they hay Sei thee object, and the decision of the Supreme Court ‘Gn Betarday, declaring that to run ra‘lroad cars ou Sanday Y# a preach of the peace, bas assisted much towards ‘hat object, The decision was scarcely reudered, which de- clared, in cffect, that under our laws there is & differesce of civil iberties, according an this or that religious opi- pu is held, beiore there was a very large popular meet- g wo propose the immediate repeal of ail laws that make this @ifference, This question, therefore, is withdrawn from the arena of reijgious disputation, and is heacetorth to be one of politica: agitation. It is no longer a question for the conscience, but one for the ballot box, and from the temper already shown, i} will boa Geree con- test. and no quarter on either side. Fortaaately for the veople, they have the right of eleoting their the . lai a their jutges id with the thorough dis- ue betore she question is seitled, there is not the least doubt that the prevailing public ‘heptiment will be fully and unmistakably iocorpo- Faved in the next enactmest. fhe elective judiciary has been denounced in some quarters asa mischievous ianova tion on old established practices; but the power of courts to make or unmake laws, and to interpret them so as to Festrict public rights, proves how inestimable is the privi lege the people possess of electing their judges, whereby ‘they can bave popular rights as secure in tne hands of ihe Judiciary as they should be in the legislative branch of the goverpment. Demagogves have inveighed against the jective franchise, but that great right of the people is tae ouly security they buve for the safe enjoyment of their civil liberties, and the people should guard it carefully from all encroachment. be question, a¢ it affects the right of the people 40 travel every day, is a question of c:y\! rights only, and as such will be determined ) ¢ sity of voters when. it is Drought to the ballot ine Sopreme Oourt, Dy @ comprehensive view o! the whole question, could buve gaved a great deal of discussion and agitation; bat perhaps it is just as weil that the Court gave the most restrictive interpretation to the law; for it Is often useful for the people to know, by public ‘discussion, upon what rights their liberties and privileges rest. ‘Judge Thompeon, in the consideration of this question, took tne Mmiied view of regarding as the two ‘antagonistic parties ‘the railread company on one side, violating law for gain, and on tho other side the eatire public, upholding the law for civil and conecientious reasons. Is this the true state of the case? Is it the contemptible issue of a railroad eompany’s profits as ageiost the peace of the city and the consciences of the people? If thie were all it would not be iffivult to determine, for there probably wouid beno great difference of opinion respecting it, But the real question ‘at issue is the right of the people, as against the assump- tion of @ portion of the community, who would restrict ‘Uhat right = The right of every individual in the commu- nity to travel when he pleases and in what manner he pleases, and the right of those entertalaiug peculiar views of the sanctity of the Sapbath to stop bim. The railroad ecmpany, as only the means through whish the people ‘would exercice ‘tbat right, ie not, politically, m party to ‘the question at ail, 14 will be very difficult to epavince the common sense of ‘bis community that if a bas a right to travel on Sunday, without moleatasion, as Jud Thoupecn says he bag, that be may be debarred of this right altogether, ba- @ause the means be employs do not suit tae notioas of godliness which are entertained by a portion of the com- mupity. If he bas the right to hire a cab of the keeper of « livery stable, without either of ther violating the law, as Judge Thompeon says be hus, why bas he not the right, to ire a railroad car, and boih be equally inoffensive to the law? Does difference in numbers carried constitute a @ifference in principle, whica would make one aa offence ‘and the other not? The hire, in both cases, ia for inai- ‘vidual gain, but the accommodation of so many more per. sons makes the necessity of ‘worldly employment” greater for the railroad company than {t is for the keeper Of the livery stable. Sut, says the Ju. ge, the exercise of the right in a railroad car disturbs’ worship in eburches, the peace of individuals residing on the railroad route, and becomes a breach of the peace, if complained of, But any complaint as to ‘be manner in which a pub!is right sail be exjoyed must ‘be reasonable, No mere whim, no capricious value se: pon quiet, no fanciful annoyance, nor apy peculiar ae oe euperior sanctity of cne day out of ie 81x, Ovght to be allowed to interfere with the rights of the public na government of equal laws. 1a toe matter of dysturbance, the proof wasasstrong in favor of the qolet of railroad traveiling as it was against it, aud the Tights of the Pabiic being aifected, the people abould hare had she benefit of any doubt in the matter Will any candid, unprejudiced mm declare that the Tailroad car does make euch a disturbance as fo iaterfere witn the worsbip of any congregation whose he: is in the exercise of that duty? The novelty of the Sunday car may call greater attention to it, but custom must soon render the most senaitive ears indifferent to it, Onurcnes worship pow, some every night im the week on extraordinary ‘occasions, and yet they do no: com fed ‘though railroad cars and every other yebice favel the streets during the whole period. In fact, 80 litle noise coes the car make compared with any other kind of carriage, that City Counciis required beils to be attached to the horses to warn the Public of the spprosch of the car. The rumbling of these cars con- Phues but ‘a half minute at any one time, passing any one place. A car passing every six miautes would be ten pars va hour, or tive minutes disturbance in every hour. Church service lasts an hour and a half, conee- quently the service could be disturbed only seven anda baif minutes any one seeston, and only a hiif minute at a time, or not Jopger than is necessary for the minister to recover bis breath. Now, will any person say tbat this is such @ disturbance as to deprive s1x hundred thousand people of one of their undoubted civil righte? Church Congregations have rights, but they hold them in subor. diwation to, and in conformity with, great public Fights, and it is much more reasonable that they should retire tbe line of the etreet, 80 as not to be disturbed, taan tode- mand that the whole community surrender their rights for the accommodation of the limited number of congregations who reside on the line of railroad travel. That the noise of the passenger cars on Sunday offends the conscience, ‘and not the hearing of the strict Sabbatarian, is evident from the fact that the locomotive, with ite ’ screeching steam whistle and its load toned warning deli, comes fre- quently into the thickly populated part of the city oa Sun- day, and has deen doing it for years, at Ninth and Green streets, without so much as 2 gingle remonstrance from the churches and citizers on the line of the railroad, or a single arrest for a breach of the peace. I¢ it was not for the fear that railroads for the common people would carry ‘them away to the country from tue churches, we do not Delieve there would be a single com t of their running; and if we thought that any indivi religious feeling would be impaired by (xtending this accommodation to travel, we ebould not say one word in its favor. On the contrary, we believe it would take them away from scenes of vice and disaipation wh cn meet them every- where in a city, aud from whose temptations chey can searcely escape when al! the avenues to rational ‘and innocent enjoyment are closed to them. Tuere is no country in the world more moral and religioas than Eng- land. “Yet the English Parliament had to concede tne rignt of Sunday enjoyment tothe people, and we have yet to bear that they have become any more immoral and lices- thous from the privilege. Twenty years ago in this city the Sanday rars ran on passenger railroads, but they did not seduce people away from the churobes, and Sanday was not blottea out of the religious observance of the peo- ple. They ran till they died out for want of pablic sup Pert, which sbows that they had no influence for evil at ail over the people, and did not add anytutog to the then existing irrelgious tendencies. Then churches did not contider travelling ia cars.a breach of the peace, and yet they were twenty Sears nearer the primitive times which are held up to us asa pattern of simplicity, virtue and religion. MASS MEETING OF CITIZENS IN PHILADELPHIA. The notice of the fact that a meeting of persons in favor of running the passenger cars oo Sunday attracted a jarge crowd in Independence square, on Saturday evening. ‘There could have not been ese than five thousand persons resent, and the mecting would have been much larger But for the fact that no stage had been erected for the epeakers, and many persons left before the meeting was organized, under the impreesion that it bad been aban- doved. Finally, an old wagon was procured for the offi cers, snd Mr. Aqnilla Pascoe was chosen Chairman. The call of the meeting was read, and Mr. Josian Bonn, a member of the Society of Friends, pushed his way tbrou,h the crowd, and baving announced his name was introduced to the meeting. He sald he desired to say a word in regard to the principles annunctated by the foun- der of Pennes}vania, William Penn, Ho taught that the Sabbath should be observed just ag the lowly Jesus pre- scribed. Jesus that the Sabnath was made for man, and not man (or the Sabbash. One day of rest in seven is o pbysicel necessity, and he @id" not think there was an indiviqual preeent who would have it otherwise ; but when we come to be tled down by “priestoraft,” we might a8 well bo tied down by “king. craft.” He’ ¢evired to bear his wetimony to the liberal eentiments of Peon, who preached tho largest liberty of conscience. “I wish to worship God according to the dic- tates of my OwD copecience, and oibers have the same Tight.”” How muob law may be violated by these cars in parsing a church on Sunday, am not lawyer enongh to say; but I have an idea that they would not disturb me in wy worship if my heart was in the right place. (Cheers, ‘apd cries of ‘That's eo!’} Ido not underatand taoge fol- towers of the lowly Jeeus when they endeavor to call in the use of physical force to sustain that yery power in which they claim to have so much faith. (Cneers.) The Friends have never called upon the strong arm of the law in order to convert the world to their religion. The world is not to be reformed by euch means, The day the cars commenced runing I was away from the city, attending to my duties as a preacher; and when I returned home, [ was informed by my children that they had commenced on that day; I said T was thankfuly that is, I was one of the few preachers who did not believe in preaching for pay, and it would be convenient for me to go to distant parts of the city on my mission, aud, in addition, to reatore my physical system: for, my friends, I have no idon of eaving my soul a: he expense of my body, (Applause ) Iam one of those men who have a tender regard for the conscience of those who aro weak, and particularly those who are poor, and wish ielators who maki ? them to enjoy their ighta without inf T would like those who bave this tastier at: near tors forth their strength, and in a peacrable manner, I wan at {Spring Garden Hall, and I confess I rit there manifested By ‘this I do pot mean to reflect on my fellow preachers, but they may do things that my Master will not allow me to engage fa— they can take pay for thoir preaching. (Laughter.) When this movement was started, I said 10 one of those inte- anata ba will notice ihe vice =, misery and d rt existicg in ali ‘ts of the cit; id and Ley vaaee a vA bore rene ANDREW MiLtER, Beq., of the Common Counoil, folk and read the following resolutions, which wore ptopeede Whereas, The people of Pennsylvania have by tha con- stitution of thelr commonwealth declared that ‘ no prefo- rence ehall ever be ee by law te any religious estab. Resolved, That we iook upon the fanatical cpparneeni of the opponents of Sunday travel, recently held at Spring Garden ‘and other places, as detrimental to the best ipterests of tae community and as deserving the condem- Dation of all true lovers of uber and independence. Resolved, That the president of this meeting be directed to appoint @ committee consisting of four members from each ward (ninety-aix) whoss duty shall be to endeavor to obtain such legislation as will meet she objects enuncia- ted in the foreguing resulutions, and who ghall have power to do auch other acts as wil ire the success of the principles hereinbefore annancit Mr, Mux then addressed the mi the numerous vioiations of the Sunday law which these Christians did not eee tt to notice, He thought it was the strangest law, apnounced by a Judge of tre Sapreme Court, tint the driving of @ car with two horses is a Dreach of the peace, while the driving of a carriage, with four horses is not. Sach an opision was iegrace to State, ard grace to the man who uttered it. Hecould see no relief from the law, which was a clear violation of the constitution. All the judges sustained it in the Pitts- burg caee, and the judge in the preeent case has gone fur- ther than all the others. Tho only relief was aa applica. bon to the Legislature. Btart the cry—repeal—atier re- Peal. (Immevse cheering.) Don’t give it up until the question fe settled. He ssid the question was no new one; it had been fought and wog in the bers’ above (referring to Councils) six months ago. Then it was that the same gentlemen who addretsed the meetings a+ Spring Garden Hall atempted, by ordinance, to prevent the runoing of ihe cars on Sun. day—ali know with what success They were beaten by s erpeeneies: Of the people—representatives of both po) parties. Mr. Conen followed, and contended tbat, from the course things were taking, it'mus; be that ‘the Church must rule the Staie, or the State must rule the Charch. History informs us that # State prospers in proportion to its being disconnected with the Church. The question is, whetter tho solemnity of the Sabbath is to be endangerea by the runnmg of these cars, Many mechanics, after having been engaged for six days at their work, conclude to enjoy the Savbath 28 a day of reat, by sleeping rather later in the morning thao usual; and he would ask whe- ther the ringing o: the church betls wonla not disturb bim—wheiher there belis do not make more noise than the running of the cars? (Cheers.) Auother question —if itis wrong to harness horses to a car, is it no: wrong to harness horses to a carriage to take a miniater to church? (Lavgbter and cheering.) The decision has been ren- Cered this afternoon against us, but it now depends upon the pecpies who elect those who make the laws. Dr Joyzs, the next speaker, was gorry to learn that the ministers were becoming #0 sensitive in their hearing. Even the Rev. Jonn Chambers, whose church is a mile from the railway, was affected. There are many wonder- ful things in this ejgnteeath century, and one of the most wonderful is, that a Methodist preact acher should ‘de disturbed by the running of a car by hus church. I have read that @ certain Daniel was thrown lato a lion’s dep; while there be prayed to the Almighty to be delivered, ‘and he was delivered. Suppose Mr, Bertine had been’ in the lion's den, he would have offered po prayers because the beasts disturbed him, and the ovly way he could have got out of the difficulty would have been by calilog upon the Mayor fora Vag to suppress the noire. {Laughter and cheers ‘M. Coates was caited on, and in address. ing the” meeting he took the ground that the laws of the State enould be adminstered equally to all slike Is it right to goto cburch? Then you must not be compelled to attend ® particular church, and if your church is three or four miles from your resi: ce, and you takea vehicle ofany kind to reach it. e are obeying God’s command. As a physician, bo nad visited a Jady in the lower section of the city, and bhe told him she was not able to see her mother. ‘She lived four miles from her and ag she was employed all the week, and cers not running on the Sabbath, her health would not the permit ber to visit ner. Years ago these railroads wero not a necessity. Now the rural districts are being settled. Toe city was then the centre of wealtu an influence. Since then the wealthy have environed the whole city with palacer, as with a wall, and they swear by Gordon and Thompson that the poor man must stop at home in the city to live or suilvcate there. A motion was next made and sdopted' that the Chair- man select bis committee during the week, and thegmeet- ing adjourned to meet at the same place on Saturday eveniwg next. The vast concourse of people then quietly dispersed.
