Dewey expressed pleasure at the pleas, entered after the State had rest- ed its case. “This is the end of the key figure n the poultry racket,” he said. “For more than 10 years ‘Tootsie’ Herbe.t has been a leading figure in the under- world, using his union position (busi- ness agent) to dominate a great in- dustry, raise the cost of poultry in this city and cause untold misery to merchants and workers alike.” David Diamondstone, 38, president of the union, and Harry Frankel, 43, eecretary-treasurer, joined Herbert in pleading guilty. Herbert and Frankel faced sentence, on four counts, of 20 to 40 years. Diamondstone, who pleaded guilty to one charge, faced a maximum term of 10 years.
