Trenchard, who sat at the Flemington trial, will | not take part in the appeal. | Hauptmann himself will not be | present at the hearing, and the at- tendance will be limited to about 75 persons. |~ The carpenter’s lawyers, C. Lloyd | Pisher, Frederick A. Pope and Egbert Rosecrans, have assigned 193 reasons | why they think Hauptmann’s convic- | tion should be reversed. All are based | on alleged “errors” in the conduct of | the trial. | Of the total number, 42 relate to Justice Trenchard’s charge to the jury. Most of the others are based on his rulings on evidence. The State built its case on evidence | that Hauptmann (1) possessed and had passed a large portion of the $50,000 rarsom; (2) was the man o whom Dr. J. F. (Jafsie) Condon paid the ransom and whose voice Lind- bergh heard calling Dr. Condon the TR 2res O 93 D. Should there be an affirmation of | the conviction Hauptmann has one more chance in New Jersey. He may appeal to the Court of Pardons for clemency, but thai court seldom commutes death sentences to life im- prisonment. Hauptmann awaits the verdict sto- fcally.
