B the Associated Press. , DENVER, April 27.—The “send-a- dime” chain letter fad rocketed to a “send $10” level today, as the Post | Office Department at Washington branded the entire scheme illegal. Nevertheless, nearly 100,000 letters | flooded the mails here today, perplex- ing post office officials who had plead- | ed that the practice be stopped. Re- | ports came that the chain idea was | Appearing at Sioux Falls, S. Dak., and Omaha, Nebr. A weary postal inspector mobilized sufficient evidence to “make an ex-| ample” of the first arrest in the $10 enterprise. But when an intended | prisoner was revealed as the head of @ family, on relief, with a crippled daughter, authorities accepted his pledge to quit the game and released him. Would Have Collected $10. Roy E. Nelson. the inspector, dis- | closed that the man questioned K was | the originator of a “send $10” letter | which contained the names of mem- bers of his family scattered over the country. He acknowledged a plan. authorities said, under which he and his relatives would have collected $10 bills without sending any. Solicitor Karl Crowley of the Post Office Department rendered an opin- | ion, which also was forwarded to Iowa postmasters, to the effect that “the scheme is in conflict with both the postal lottery and fraud statutes.” Enforcement of the opinion was a thorny problem, because of the neces- sity of obtaining a search warrant to open suspected pieces of mail—a task rendered virtually impossible by the postal volume. United States Attorney Thomas J. Morrissey. his assistants and the in- spector, after a conference, said “We wil! be guided by the legal principle of de minimis non curat lex, which means that the law does not take notice of trifles.” “Send-a-Pint” Letter Found. This decision pointed the full force of the Federal investigation at the 810 letters, with the idea that their stoppage automatically would curb the dime chain. Another new chain, called “send-a- pint,” was reported circulating in Den- ver. It was similar to the dime. $1 and $10 letters, except the receiver “was asked to send a pint of liquor to the person whose name was at the top of the list of five names contained in the letter.
