DETROIT, January 15.—Michigan’s stiff tax on raw materials used by home brewers was upheld as constitutional yesterday in an opinion of Willlam S Bayres, jr., standing master in chancery in Federal Court. The opinion, which now goes to & three-judge court for action, was given in the case of Standard Brands, Inc, of Cincinnati, manufacturers of a bakers’ malt Plea Previously Denied. The three judges—Arthur C. Denison of the Circuit Court of Appeals and Charles C. Simons and Edward J. Moinet of the District Court here—previously had refused to grant the corporation a restraining order against the State. Sayres held that since a State has the right to prohibit manufacture and sale of intoxicating liquors it also has the right to prohibit manufacture and sale of materials used in the manufacture of such liquors.
