B—16 PLAGIARISM SUIT 15 WON BY O'NEILL Court Will Take Up Charge “Death Takes a Holiday” Plot Was Stolen. | By the Associated Press NEW YORK, April 23—Now that Miss Gearges Lewy's $1,250,000 plagiar- mr. suit against Eugenc O'Neill over “Strange Interlude” has been disposed | of, the courts will presently turn their | attention to the charge of Miss Myra | Wiren that “Death Takes a Holiday” was pirated from her play “Most." Miss Lewys' case, which was tried Jast month, was dismissed yesterday. Miss Wiren's suit was filed while Miss Lewys was awaiting the decision. Her play was produced on Broadway some years ago. Each year’s successes bring a new as- | eortment of plagiarism suits. Every | song hit is potentially material for an | action based on charges of copyright | infringement. | Plagiarism Suits Recalled. That's why the big movie studios re- turn unopened most of the thousands of scenarios so_ hopefully submitted to them. That's also why Rudy Valiee has to be extremely careful about trying out_the songs of amateur composer: There's hardly a well known p wright or producer in New York who hasn't been the defendant at some time or other in a suit charging copyright | infringement Valeska Suratt and Mirza Ahm:d Schrab sued Cocil de Mille, charging that he stole “King of Kings," based on the story of Jesus of Nazareth from a y Schrab called “Mary Mag- Howard has been sued | twice, once for “They Knew What They | Wanted” and_oncs for “The Silyver Cord.” David Belasco was charged with having stolen the plot of “Cradle Song” for a play called “Marie Odile.” And away back in 1892 Augustin Daly ac- cused George F. Webster and William A Brady of having ted “After Dark” | for “Under the Gaslight.” Daly One of Few to Win, Mr. Daly won. Most of them do not. Anne Nichols demanded $3,000,000 Tom a picture concern, charging that “The Cohens and the Kellys” was stolen | from her “Abie’s Irish Rose.” The| picture company said it lifted the plot | xfmm “Romeo and Juliet.” Miss Nichols | ost. One of the most celebrated cases was that of Mrs. Grace A. Fendler against Oliver Morosco and Richard W. Tully, | charging that Tull ird of Paradise” | was based on her “In Hawail.” In the! lower court she was awarded $781.891./ Finally after the case had been| dragging on for 14 years, the Court of | Appeals reversed the decision. CHILDREN ESCAPE FLAMES | IN GREENSBURG THEATER Wild Confusion Reigns in Stam- pede for Doors—$100,000 Loss in Series of Fires. By the Associated Press. GREENSBURG, Pa., April 23.—More | than 250 persons, most of them chil- dren, fled from a motion picture thea- ter at Yukon, a mining town near here, iast night, when fire broke out above ! the operator’s booth. | A few minutes later a second fire| was discovered in the cellar of the| theater. At the same time fire broke put on the third floor of a garage across the street. Firemen estimated the lo &t_$100,000. | The flames spread to half a dozen other buildings, four of which were de- | stroved. The post office building was slightly damaged. No one was injured, although the| audience, many of the women and chil- dren hysterical, scrambled from the theater in wild confusion. Origin of the fires has not been de- | termined.
