LOS ANGELES, December 12—A @divorce suit on file here today asserted Tom Mix, hard-riding, quick-shooting ©owboy of the screen and the circus, had' galloped away from home and didn't intend to come back. Mrs. Victoria Mix, in filing the suit yesterday, said Mix left November 26 and by way of emphasizing his state- ment that he would not be back twirled & loaded gun on his trigger finger in %iid West fashion. She was greatly grightened, she said. Mix had left home several times be- and upon his return declined, his wife charged, to reveal where he had en. During the-last absence their 8-year- old daughter, Tomisina, became ill, Mrs. Mix said, and but for the fact that through “gossip” she learned he had been spending most of his time at Agua Caliente and at a Hollywood Hotel she would not have been able to summon him to the child’s beside. While Mix always was a hero on the screen, his wife pitcured him as a dif- ferent’ character outside the films, He treated her with “extreme cruelty” for the past five years, she charged. “Mr. and Mrs. Mix were married in Riverside, Calif., in 1918. In suing for divorce, Mrs. Mix asked the custody of their child. The actor transferred to his_wife in Tanuary, 1928, property val- ued at $100,000, including their Bev- erly Hills home.
