Holding that a lease is valid between the parties * without acknowledgment before a notary public, the District Court of Appeals, in an opinion by Justice Van Orsdel, yesterday reversed a decision of the District Supreme Court in the appeal of the Munsey Trust Co. which had been denied the right to recover against Harry Alexander, Inc., for rental of certain rooms in the Mun- sey Building. The declaration had been filed in covenant and the lease was attached as an exhibit. The defendant corporation demurred on the ground that the lease was invalid because it had ,not been ackniowledged by the lesso: coporation. The lower court sustained the demur- rer and the Munsey Trust Co. ap- pealed. Acknowledgment, the court pointed out, is merely for the purpose of record- ing the paper for the protection of creditors and purchasers and is essen- tial as to persons of that description, not as to the grantor. His estate passes out of him and vests in tie grantee and in a suit between tiem a transfer of property is completely executed and would be conclusive, although never admitted to record nor attested by any subscribing witness, POLICE COURT ORDER SET ASIDE ON APPEAL Prior Ruling Affecting Seizure of Autos Under Dry Law Is Reaffirmed. ‘The Court of Appeals, in an_op‘nion by Justice Van Orsdel, affirmed it< re- cent decision that an intervenor who holds a mortgage on an automobile seized for condemnation under the na- tional prohibition law is entitled to prosecute an appeal from the Police Court, and sustained the claim of the Manufacturers’ Finance Co. to the re- lease of an automobile. The judgment of the Police Court was reversed. An_automobile salesman approached by & bootlegger to buy a car recognized that a conditional sale to him would not be financed and substituted the name of another person to the contract and the standing of that person was passed favorably by the finance con- cern. When the car had been seized, the company pleaded that the contract was fraudulent and that the alleged fraud was not known to it or to the sales company. The court held that its ruling in the General Motors Acceptance Co. case was controlling and reversed the action of the Police Court and directed the return of the machine. BANKER SENTENCED Will Serve 16 to 223 Years on In- dictments on 25 Counts. FORT SCOTT, Kans., June 3 ().— P. H. McAfee, 47, former president of the defunct People's State Bank here, pleaded guilty yesterday to 25 counts charging embezzlement, forgery, viola- tion of the State banking laws and fraud. He was sentenced by Judge Charles F. Trinkle to serve a total of 16 to 223 years in the State penitentiary. The bank closed recently with a shortage estimated at $213,000.
