Its first attempt to apply the “ex-| cess earnings” clause of the transporta- tion act overthrown by the Supreme Court, the Interstate Commerce Com- mission today made a new approach to its problem of collecting from the rail- roads the “excess earnings” as defined by law, ‘While there was some doubt whether the new proceeding would fulfill all of the requirements of a new test case, the action _instituted today was the first since the Supreme Court overruled the lan of collection which had been fol- wed in the original test aaginst the St. Louis & O'Fallon Railroad. The commission today tentatively ordered the Brimstone Railroad & Canal Co., a small line in Louisiana, built by the Union Sulphur Co., now no longer in operation, to pay $260435.61 to the. Treasury as excess profits for the 1920 to 1925, inclusive.
