Minn., February 13.—The State of Minnesota went into United States District Court today to prose- cute a customs officer on charges of second degree murder. ‘The Government itself is defense at- torney. for it has contended that the defendant. Emmett J. White, acted within his rights when he shot and killed Henry Wirkkula of Big Falls,| Minn.. last June 8. One woman is on the jury, which was terday. An’ early witness for the State was to be Mrs. Wirkkula, who was with her husband and two daughters when White and another customs patrolman ordered the Wirkkula automobile to halt and submit to a search for liquor. The Government contends that Wirkkula | disobeyed the stop order, and that it was only then that White opened fire. Judge William A. Cant took the pre- caution of having the jury placed in custody immediately after its selection, because of sharp expressions of senti- ment. Wirkkula's death came into wide prominence when the city council of International Falls, where he was for- merly a resident, sent an appeal to President Hoover complaining that Federal officers were interfering with constitutional rights of citizens.
