Get-rich-quick schemes that seek ra- dio outlets are finding the vigilant eyes 2{] the Better/ Business Bureau upon em. In the absence of laws prohibiting the broadcasting of matter barred from the mails and newspapers, the various branch offices of the Better Business Bureau are being instructed to invite complaints from the public and to in- vestigate suspicions of misleading or unfair advertising on the air. A questionnaire recently circulated by H. G. Mitchell, manager of the Bir- mingham, Ala., Better Business Bureau, reveals the fact that local bureau chiefs not only are on the alert against mis- representation by radio but themselves | are using the radio to warn the public against shady propositions. Fraud on nthe air can only be curbed by the management of broadcasting stations, although it is within the - ince of the Federal Radio Commission to inquire into the character of the type of advertising broadcast when a station seeks a renewal of license. Neither the postal laws nor any State laws can be invoked against promoters of questionable enterprises who use the radio. Even the Federal Radio Com- mission’s authority is vague, for it rests wholly upon the section of the radio act which empowers it to determine whether a station is ting “in the public interest, convenience or neces- sity.” ’¥'he inadequacy of the law's efforts to keep pace with radio’s progress is evi- denced further by the fact that libel and slander uttered on the radio cannot be prosecuted under existing statutes, in the opinion of some lawyers. Only occasional complaints have been registered with local stations or with branch bureaus against advertisers charged with violating the ethics good business practice on the radio, cording to a paper prepared by Mitchell for presentation before the annual conference this week of the Bet- ter Business Bureau at San Diego, Calif. ‘The majority of the complaints, when referred to the stations, led to the im- mediate deletion of the ma- terial.
