IN CIVIC DISPUTE Potomac to Sue Mount Ida Citizens in Septic Tank Overflow Controversy. Special Dispatch to The Star. POTOMAGC, Va., June 15.—Corpora- tion Attorney Walter U. Varney will ap- pear Monday morning before Judge Howard W. Smith in the Circuit Court for Arlington County at the Arlington County Courthouse and ask that an in- junction be granted against the Mount| gamaged Ida Citizens’ Corporation to stop the alleged unhealthy condition created in the northwest section of Potomac by the overflow of,the Mount Ida septic tank into an open ditch within the town lmits. Varney and State Senator Frank L. Ball of Clarendon, counsel for the Mount Ida organization, have taken their depositions and will submit them to-Judge Smith, who then will set a date for hearing the arguments. The matter has been a subject ‘of much controversy during the past few | Was years, but the request for the injunc- tion will mark the first legal step in the case. Several months back the Potomac Town Council offered to permit the Mount Ida body to use Potomac's right- of-way to Four Mile Run for the con. struction of a trunk-line sewer to elim- inate the condition caused by the tic tank overflow, but the citizens’ cpr- poration never took any definite action on the offer. It was then that the council decided to press legal action in an effort to halt the alleged nuisance.
