PHYSCANS FREED ~ INDBATHOF BOY ] Operationin Tennessee Home | Held Not to Constitute Murder. By the Associated Press. ELIZABETHTON, Tenn., March 13.— Dr. Murrell Pinson and Dr. W. H. Longmire were free today of charges that the death of 12-year-old Robert Grindstafl, after they had operated on gim for appendicitis, constituted mur- er. Magistrate R. T. Johnson, sr., at a preliminary hearing, late yesterday dis- missed the murder charge brought by the lad's father, Henry Grindstaff, on the ground that the State had failed to make a case. The dismissal came after the elder Grindstaff and a dozen neighbors testi- fied the two physicians had operated on the boy on & Kkitchen table in the Grindstaff home, by the light of a kerosene lamp and a flashlight. The father also charged Dr. Pinson was in- toxicated. Dr. J. B. Shoun and Dr. J. L. Cottrell, who performed an autopsy of the boy's body, testified they found evidences of an appendicitis_operation. but the ap- pendix, which had. not been removed, was normal. ‘The defense, in cross- examination of the witnesses, sought to establish that the operation was a result of an error in diagnosis, and that the boy was in danger of death before the operation was performed. LIEUT. COL. DASHER GETS HIGHER SERVICE POST Reserve Army Officer Promoted and Placed in Charge of War Department Estimates. Lieut. Col. Charles L. Dasher, who has been investigator for the Bureau of the Budget, has been promoted to be assistant to the director and placed in charge of War Department estimates. Col. Dasher, a Reserve Army officer, has been investigator of War Depart- ment estimates under H. N. Wiseman, assistant to the director. It was found that both the War and Navy Depart- ment estimates were too heavy a load for one assistant—Mr. Wiseman—so the ‘War Department estimates were given over to Col. Dasher, who was promoted to assistant to the director. "~ Three Dead From Gas.
