NEW YORK, April 13.—Counsel fot the family of Walter S. Ward, ad- mitted slayer of Clarence S. Peters, Whose death is being investigated by the attorney general’s department, has begun action against the Western Unfon and the Postal Telegraph com- panies and Deputy Attorneys Gen- eral Chambers and Cohen to test the walidity of the state peace and safety act of 1917, under which the attorney. general is conducting the Inquiry. The action by the Ward counsel came after Supreme Court Justice Staley at Albany had issued an order that the Western Union and the Postal companies show cause why they should not produce the cable mes- sages and telegrams sought by the attorney general's office. The Staley order is made returnable at Albany Saturday, but the latter subpoena on the telegraph companies and the at- torney general's department is re- turnable today. It was announced that Attorney General Sherman would not press ac- tion on the Staley order, as he had been assured by counsel for the tele- graph companies that if the act in i question is declared valid the cable and telegraph messages would be produced immedlately. Complete accord was sald to have been effected between the attorney { general's department and counsel to + the telegraph companies, representatives of which held a secret conference yeste: day with Attorney General Sherman &t his office in this city.
