By the Associated Press. 2 NEW YORK, November 22.—Sul# for the recovery of $200,000,000, which, it is alleged, is the amount of loss sus- tained by the Denver and Rio Grande Raflroad as a rdsult of an unlawful combination and conspiracy on the part of men who served on the direc- torate of the railroad during the past ten years, was started yesterday in the supreme court. The men named as co rators in the complaint, which was made by a committee "of stockholders, 3 George J. Gould, Edward T. Jeffrey, Arthur Copgell, Edwin Gould, King- don Gould, Edgar L. Marston, Benja- min F. Bush, Edward L. Brown, Ed- d Adams, Finley J. Shepard, arris ‘Willlams, Benjamin B. Me- Alpin, George G. Haven, Henry U. Mudge, James Horace Harding, Harry Bronner, Charles C. Huitt, John H. McClement, Alvin W. Krech and Alex- ander R. Baldwin. The Denver and Rio Grande Railroad Company also is_named as defendant. . This action is the climax to the ef- forts that stockholders have been maknig over a period of nine years toward having the finances of the company thoroughly investigated. Committee Brings Suit. In 1920 the stockholders’ protective committee was organized and the suit brought is the result of its efforts. Among the members of the_commit- tee are George T. Powers, Joseph J. ga%ulv;. James Nelson and Benjamin - In its complaint the stockholders’ committee asserts that for many years the Denver and Rio Grande rail- road carried on a prosperous business, and in the ten years from 1900 to 1910 paid preferred dividends in full. The complaint alleges that in 1915 the defendants entered into a con- spiracy to wreck the Denver and Rio Grande, and to cause all its properties to be absorbed and wiped out by ad- verse interests. rge Interest Was Defaulted. As the first step in this direction, the complaint says, the alleged con- spirators, directors of both the Mis- souri Pacific and the Denver &nd Rio Grande, caused the latter to default a mortgage interest payment to the Western Pacific, although the road had ample cash resources to meet the same. By this action and suc- ceeding ones the directors caused foreclosure proceedings to be ini tuted against the Rio Grande, it add: In one protest sent to the dire: s the stockholders’ committee wrote: “During the past few months the directors and officers of th& Denver and Rio Grande have been mute and immovable, while a death blow was being dealt the company.
