Viectory by the government yester- day in three income tax cases before the Supreme Court not only will bring into the Treasury $30,000,000 in taxes «due under this decision, but will make possible the adjudication of many claims of similar nature, w! have been pending in the T Department, totaling many tional millions. Dividend Taxes Issue. All three gquestions involved taxa- tion of stock dividends as income, two_ being similar in the cases of stock issued stockholders of the Ohlo Oil and the Prairie Oil and Gas com- panies by the Iilinois and the Prairie Pipe Line companies, respectively. The pipe line companies wers organ- ized by the oil companies and, cording to the majority opinion "ot Justice Pitney, the new stock repre- sented assets of the oil companies, standing in the place of the pipe line, properties that were formerly classed as surplus assets. As the stock was capable of divi- sion among the shareholders, the opinion said, and the pipe line prop- erties were not, the distribution con- stituted in the case of each individual a gain in the form of actual ex- changeable assets and was in effect a dividend of profits by the corpora- tion and individual income to the stockohelrs. This contention was 0p- posed by the eompanies and many stockholders, including John D. Rocke- eller. The third decision by the court was in the case of the organization of the E. L du Pont de Nemours Powder Company of Delaware by the parent company of the same name in New Jersey, which turned over to the Dela. ware corporation all its assets anh took in exchange the stock of the new company. The new stock, which was distributed among the stockhold- ers of the parent company, was held by the court subject to the income tax law.
