At 5:40 o'clock in the afternoon the jury in the thirtieth district court, after less than an hour’s deliberation, fourd him.guilty of the murder of his father, Otto H. Toussaint, and fixed his punishment at death. I The defendant received the verdict of the jury without giving the slight. est indication of nervousness. His Young wife, who sat by him through- out the trial, which consumed eight days, fell into a faint when the ver- dict was read. Quick Verdict Surprise. The knock at the juryroom door within less than an hour after re- tiring came as a surprise to the crowded courtroom, who refused! to give up their. seats upon conclusion of arguments. It was a desd si- lence that reigmned: when Judge Wel- don slowly read the verdict with the death penalty attached. Attorneys C. C. McDonald, Luther Hoffman and B. Y. Cummings, counsel ! for the defense, spoke in the order named | and made a dramatic plea to declare, the defendant insane, reviewing the | testimony adduced from the witness! stand, which, they declared. pointed ! conclusively to the fact that Toussaint | was an incurable paranoiac. - Rormer | County Attorney Davenport opened the case for the state. He dwelt at length on the fact that there could be but one of two verdicts rendered, either the defendant was insane or that he was guilty of ome of the most brutal murders perpetrated. in this ! county and that the death penalty was. the only penalty commensurate with the crime. Primitive Baptist Church Minister Passes Away. Word has been received here of the death of Elder S. L, Thompson; min- ister of the Primitive Baptist Church, Who died Monday at Laurel, Md i} Funeral services were held this after- noon at 2 o'clock, at Columbia Bap- tist Church, Burtinsville, Montgomery ] county, Md. Rev. Thompson was a minister of the gospel for the past forty-two years, having served churches in Vir- ginia, West Virginia, Ohio, Pennsyl- vania, Maryland and this city. When 2 young man_he was sheriff of Fair- fax county, Va., being a native of that place. He was considered an eloquent speaker and an authority on || ecclesiastic questions. Charges Libel in Publication or' Article Attacking Society. ‘ LOS ANGELES, Calif., August 4— The Knights of the Ku Klux Klan, a corporation, yesterday brought suit for libel against the .Los Angeles Express Publishing ny.. a cor- poration, demanding $150,000 dam- ages for the publication in three publications of an artigle over which appeared bannér lines reading “Great Ku Klux Outbreak,” “Ku Klux Terrorizes South” and “Ku Klux Reign of Terror.” The article, which was set forth in full in the complaint filed in the sy- perior court here credited certain Taids in southern states to “secret or- ganizations similar to that of:the Ku XKlux Klan of reorganmisation days,” .
