Dr. Hay recalled at Judge Wilson's re- quest an named by him yesterday the temperature at the surface of the earth would be lower than at the elevation at which the weather bureau takes ite observation. At a temperature of thirty-five at the height of 75 to 100 feet it could not be said that the temperature was not at the freezing point on the surface of the earth. The humidity at the time of the shoot- ing was seventy-two degrees. That is, there was some moisture in the air. Ke-direct—The difference in temperature be- tween such height and the svrfuce of the earth varies. Some observers put it at ten degrees. He could not say that there was much differ- ence that night. MARTHA F. CAIN. Martha E. Cain, a colored woman, the de- fense’s newly discovered witness, was then ex- amined. She was near the corner of 17th street, THE PRISONER ENTERS. on the north side of Q. She was looking toward 18th street, and saw two flashes and then three more. She was sure eke heard more. The flashes came from the sidewalk nearest the houses. Cross-examined by the district attorney—She said she was on Q street near 17th, but between 16th and 17th. She saw the flash and heard the report at the same time. She hadn't moved before she heard the second shot and she imagined she heard the bullet whistle by her. ihe first two shote were fired by the same person and at the same pointe. The first two shots were fired so quickly that the person shooting could not have bad time to change Fis hand. When the third shot was fired witness had gotten in the street. Th shot was fired by a different person and from a different pomt. She could not see the curb. You want to put him on the curb, don't you? Yes. He must have been. How many shots did you hear? At least eight, I feel confident. Iam not asking you about your confidence. Did you count them? 1 dia. How many were there? Not less than eight. The two parties fired together, Who said there were two persons firing? There must have beentwo. The flashes were not the same. How did they differ? The others were not as bright and clear as the first two. How much did they differ? T can’t say any more. ‘The witness stated that she only saw five flashes, but felt certain that she heard three re- ports after the five flashes.
