What Was Said About It in the Senate Yesterday Afternoon. ‘MR.INGALLS OBJECTED TO SOME OF ITS FRATURES, BUT URGED IT AS A COMPROMISE MEASURE—un. GORMAN DID NOT LIKE CERTAIN PROVISIONS— TEXT OF THE BILL AS PASSED BY THE HOUSE. The report of the conferees on the Bock Creek Park bill, which, as stated in Tux Sran, was adopted by the House yesterday by a vote of 123 to 65, was presented in the Senate by Senator Ingalls late yesterday afternoon, Mr. Ingalls asked that the report be immediately considered, while Mr. Gorman seemed inclined to have the matter go over. Senator Ingalls said that his preference was for immediate con- sideration, and when Senator Gorman asked for an explanation Senator Ingalls said: “‘Its Provisions are generally known and they are simple. It provides for the acquisition of a tract of land not exceeding 2,000 acres in the valley of Rock croek, at an expenditure of not to exceed $1,200,000. one-half of which is to be paid by the government of the United States and one-half from the revenues of the District, in four equai annual installments, It has been discussed in both house-. The provisions have been genoraliy disseminated through the press, and I believe that the measure, while not all that can be desired and in some respects notin accord with my own views, is generally ap- roved. I think, unless the Senator from arylaad has some particular reason why fur- ther inquiry should be made, that I should prefer to have the report acted upon tonight, WHY MR, GORMAN OBJECTED. Mr. Gorman—I am very heartily in favor of the general proposition, but in the reading of the report one or two things struck me as rather novel to be introduced in the District in an en- terprise of this sort. Mr. Ingalis—In the valley of Rock creek. Mr. Gorman—The valley of Rock creek, and it extends to the Maryland line. Mr. Ingalis—It will extend to the District line, 6 money holds out. Mr. Gorman—Very good, but the whole of it is located outside of the limits of the city of Washington, and the surrounding country con- sists of farms and dwellings and property not of very great value today, It does seem to me that to choose a commission of our own se- lection for the purpose of ascertaining what benefit the park will be to the farming country that adjoins, without the right of appeal, as I understood from the reading, is a very extra- ordinary provision to introduce into a measure here. it is rather a hardship to these people, who practically have only farms and gurdens. MILITARY GOVERNMENT. The other provision to which I allude is that we are not only to have the engineer officor of the District of Columbia, who is an army offi- cer, but we add to the military government of this District, at least so far as this park is con- cerned, and intrust the expenditure of the money of the ople of the District to another army officer, the chief of eng neers, @ gentleman for whom I bave the highest regard and who, I believe from what I have seen of him, is probably the most capable ofticer I have ever known to occupy that posi- tion, and we al! have perfect confidence in him, But to put the money, one-half of which is to come from the tax payers of the District of Co- lumbia. practically under two army officers ap- pointed for life, with no control of it by the jople of the District and no way to reach it, i going beyond anything heretofore contem- plated. I had hoped we would in the course of time, and in a very short time, eliminate that military feature from the management of the affairs of the District of Columbia and put it all in the hands of civilians; but under the pro- visions of this report we are adding to and ex- tending thoir power aud authority. That no delay in making an assess- ment of compensation or in taking posscssion shali be occasioned by any doubt which may ariseas tothe ownership of the property or any part thereof or as to the interests of the respective owners. In such caves the court shall require a deposit of the money allowed as compensation for the whole property or the part in dispute. In all cases as soon as the said commission shall have paid the compensation assessed or ite payment by a deposit of money under the order of the court possession of the property may be taken. All proceedings hereunder shall be in the name of the United States of America and managed by the com- mission. “Sec. 6. All per- sons interested may appear and be heard. When the assessment shall be completed it shall be signed by the commission or a majority (which majority shall have power aiways to act) and be filed in the office of the clerk of the Supreme Court of the District of Columbia. The commission shall apply to the court for a confirmation of said ssment, giving at least ten days’ notice of the time thereof by publica- tion in one daily newspaper published in the city of Washington, which notice shall state in general terms the subject and the object of the app lication, “The said court shall have power, after said notice shall have been duly given, to hear aud determine all matters connected with said as- sessment, and may revise, correct, amend aud confirm said assessment, in whole or in part, or order a uew assessment, in whole or in part, with or without further notice or on such notice as it shall prescribe, but no order for a new assessment in part orany partial adverse ac- tuon shall hinder or delay confirmation of the residue or collection of the assessment thereon, Confirmation of any part of the assessment shall make the same a lien on the real estate assenscd. , “The assessment, when confirmed, shall be divided into four equal instaliments and may be paid by any party interested in full or in one, two, three and four years, on or before gest to the Senator from Kansas, as it is late in the evening, for it is now 5:20 o'clock, that he let this matter go over until tomorrow morn- ing and have the report priuted, so that we may have an opportunity to look into it. Prob- ably it istrue that at this late day in the session, after the long conference which has been had, nothing better can be done; but with no dixposition in the world, as the Senator understands sere well, to obstruct the adoption of the report, I think it is due that the Senator should permit us to look at it in print tomorrow morning. I suggest to the Senator to let the report go over until tomor- row morning, so that we may have ap opportu- nity to examine it MR. INGALLS’ ATTITUDE. Mr. Ingalls—The request of the Senator from Maryland is reasonable, and if he desires to familiarize himself further with the provisions of the report I cannot object. I can only add, however, that the report is in many particulars more obuoxiousto me than it can to the Senator from Maryland. I believe that the rovision thut imposes one-half of the cost of ¢ improvement upon the people of this Dis- trict is wrong in principle an pernicious in practice. I think it sau unjust burden upon the already overtaxed resources of this people. The other points the Senator makes are somewhat in accord with my own views, but the report, as is usual in such cases, was tho result of a compromise. Ido not thiak any- thing else can be done. Imay that the provisions of the report have been submitted to the people through the Rewspupers, and have been the subject of con- sideration and discussion for s number of months, the conferees having agreed. I think, in July last. There has been, so far as I know, Bo protest on the partof the peoplo of the District against the report; on the contrary, it has been generally approved, and the decision has been regarded with favor and cordially acquiesced in by those most nearly interested. was then agreed that the report should be taken up this morning immediately after the close of the morning business. All payments shall be made to the treasurer of the United Ma who shall p the account as aseparate fund, The orders of the court shall be conclusive evidence ofthe regularity of ail: previous proceedings necessary to the validity thereof, and of all matters recited in said orders, The clerk of said court shall keep a record of all proceedings in regard to said as- sessment and confirmation. The commission shall furnish the said clerk with a duplicate of its assessment book, and in both shall be en- tered any change made or ordered by the court as toany real estate. Such book filed with the clerk, when completed and certified, shall be prima facie evidence of all facts recited therein. In case assessments are not paid as aforesaid the book of assessments, certified by the clork of the court, shall be delivered to the officer charged by law with the duty of eol- lecting delinquent taxes in the District of Col- umbia, who shall proceed to collect the same as delinquent real estate taxes are collected. No sale tor any instaliment of assessrent shall discharge the real estate from any subsequent installment; and proceedings for subsequent installments shall be as if no default had been made in prior ones, ‘ “All money 86 collected may be paid by the treasurer on the order of the commission to any persons entitled thereto as compensation for land or services, Such order ou the ‘Treas- ury shail be signed by « majority of the com- mission and shall seerity fully the purpose for which it is drawn.
