Joseph Shorter Sentenced to Two Years im Albany Penitentiary. In the Criminal Court this morning the case of Joseph Shorter, a colored boy indicted for the murder of Edward Smith by stabbing him with a fork on July 4 Inst, was called, A plea of guilty of manslaughter having been accepted he was brought up for sentence. Gen. E. ©. Carrington appeared for the accused and stated that he hada number of witnesses of the affai Mr. Lipscomb, for the government, read the Coroner's notes showing that the two had had afightin the neighborhood of 12th and W streets and were parted, but subsequently met, and Shorter inflicted the fatal blow, and he submitted the case to the court, Gen, Carrington claimed that the case was One of a not very high grade of manslaughter; be it was the result of — and the erro the wound wis an accident. He also c! that the prisoner was of good character. The prisoner took the stand and testified that they had been singing and then hada dispute over a game of crap; that Smith, who was much larger than he, assaulted him first and he went away, and that Smith met him again and knocked him down beside a tree box. He found a fork lying on the ground and strick Smith with it. On cfoss-examination he denied that when his mother took him home he went in the house of that he passed through the alley, and insisted that he found the for! He acknowl- edged that he had been three days in the work house and had been fined two or three times and was once arrested by a policeman because 8 dog had killed a cat. The mother of the boy testified that the mis. chief had been done before shegot there and that he did not take a fork from the house, for her forks wére all there.
