Harlowe, in 1*61, boarJed at the Metropolitan hotel, of which Mr. Marshal Brown was proprietor, and when she left, the bills not being pa detained her trunks, telling her tha! bill was paid they would be given up. Eight Years afterwards Mr. Brown returned the trunks, standing the bills were unpaid. Mrs. alleged that all her goods were not re- turned, and snit to recover $217, the value of the goods she claims were lost. ‘The defendant offered evidence that during the whole time the trunks were in his possession he kept | them locked up in astoreroom. The defendant asked the court to instruct the jary that if they believed the ? could have obtained her trunks at by paying the bill, used ordinary care, entitled to recover. W. Hurdle, of No. 2 engine company, cbarged with gross vivlation of rule 31, of the regulations, was taken up, and the testimony of Thomas McElroy, Wm. Palmer and others was given, showing that Hurdle had challenged Myers, another member of the com- pany, to a pugilistic encounter while on the seene of a fire, and used violent and vitupera- tive langu: Mr. McDevitt moved that Har- die be ft $10, and be reprimanded by the chief engineer. Mr. Bayly moved to amend that he be dismissed from the department; but this was rejected, and Mr. McDevitt’s resolu- tion was adopted. At a meeting of the board of health last night Mr. Langston, from the ordinance commitice, made & report on the matter of filling up lots of ound covered with stagnant water aud con- mned bythe board as a nuisance, He re- commended that a contract be made with Wm. Bowen tor filling up all such lots, and that he be authorized to collect the expenses from the owners, the board reserving advisory decision of the same; adopted.
