New standard ok ties and steel rails are being put in placo of the old material. All the old cars have been repaired and rebuilt and the facilities increased by the addition of six now and first class coaches. Tho news was received by wire in this city last evening that the jury in the case of Mrs. Worth against the Chicago, Milwaukee & Paul Railroad company, which was tried be- fore Judge Shiras in the federal court at Cedar rapids, had returned a veraict in favor of the company. The case was the first of a large number of similar suits that grow out of the accident at Coon Rapids on the 16th of last June, when a passenger train was wrecked by u gang of rovengeful ltalians and a large number of the passengers in- jured. The suit was for personal damage, the plaintift alleging.carelessuess and neglect on the part of the company, and s thers are perhaps $250.000 worth of the samo suits in which Couucil Bluffs and Omaha people ars interestea the news will be considered of consideravle importance. The suit was regarded by the attorneys for both sides as a test case, and tho very best efforts of both sides wero ca'led out.” ‘Thie company showed by unquestioned ovidenco hat the wreck was caused by ar obstruction placed between the guard rails on the bridge approach, and that it was placed thero for tho purpose of wrecking the train; that the company’s men omployed for the purpese biad passsed over the line forty minutes before the train ap- proacued and found tho track clear, and that the accident was due in no seuse to uny fault or negiect of the company or 1ts employes. This view was sustained all arcund and verdict for the company was prowptly tarned.
