Becretary Foster has transmitted to the chair- men of the Senate and House committees on immigration an opinion rendered on the 8th instant by Attorney General Miller which has an important bearing on the pending investi- gation of immigration matters. That in- vestigation has thus far mainly turned upon the question of the legality of the use by the Secretary of the Treasury of portions of the immigrant fund, derived from the head tax on immigrants, for the improvement and equipment of Eis Island in New Yord harbor asa permanent immigrant landing station. The policy of making such a use coh ares of the immigrant fund was inaugurated by the late Secretary Windom in November of 189, was continued by Acting Secretary Nettleton during the interregnum followingSecretary Win- dom's death, and has since been pursued by the Treasury Department. Inasmuch as several of the contracts for these improvements remain to be completed, and further sums of money will need to be applied to the same purpose, Secre- tary Foster on the 30th of March asked the opinion of the Attorney General as to the legal | Shag of making such further payments ‘om the immigrant fund. The announcement in yesterday's Stam that the President had approved the values fixed by the appraisers upon certain tracts con- demned for the purpose of the Rock Creek Park was received with the greatest gratifi- cation by the people of the District, It was said that many of the owners whose land was taken would continue their fight against the action of the government in seek- ing to acquire their property, but it was learned today that but two interests represented would further continue such opposition—the Messrs. Shoemaker and Mr. Truesdell. It is said that these gentlemen will endeavor to carry the case to the United States Supreme Court, urging some of the points that were argued before the Court in General Term of the District. It may be that other grounds will be urged by them in their appeal to the court, such as unjust ota the want of authority — y the Commissioners to take ess = than the 2,000 acres con- templated by the act and similar grounds, but itis understood that these matters were fully considered by the Attorney General and that be advised the President that the Executi had authority to do what he has dono in approving the values fixed by the ap- praisers for such an amount of land as would, together with the land already acquired by purchase, bring the total amount expended within the appropriation. WHAT THE COMMISSIONERS WILT DO, Now that the President has approved the values it is said that at = meeting of the Rock Creek Park commissioners to be held at Col. Casey's office at 10:30 tomorrow morning. commissioners will decide to deposit the amount of money re- quired to pay for the land in the hands of the clerk of the District Supreme Court, If this is done, then the court would direct that the amounts approved be id to the owners upon their establishing their ownership in the jands designated. The Presi- den: approval of the values vested the titl to the land in the park commissioners and at the same time of course established the right of the owners against the government to the amounts in question, a right which it is believed Con- gress could not remove by a repeal of the act establishing the park. The act is somewhat ambiguous on one point. It fails to state just how the money shall be ‘id to those owners, the value of whose land been approved by the President. It states, however, that should any owner refuse to accept such approved valuation, the amount sbali be paid into court, and it is believed, as stated, that the Commissioners are of the opinion that they the authority to deposit the entire amount in court with the request that the court direct the amounts to be paid to the several owners as they establish their rights to the satisfaction of the court. OWNERS OF EXCLUDED TRACTS. It may be that some of the owners whose property, although condemned, was not finally taken, will contend that their land having been condemned and appraised a right to recover the valuation fixed by the appraisors was thereby established. The authorities, however, do not, it is said, warrant such an assumption. Condem: is merely a legislative decla- ration certain lands shall be taken for public uses, and it is only effective to the extent of compensation tothe owner. Con- demnation, ereiore, it is held, is not & judicial act, and_ establishes, it is said, no claim beyond that of one for dumages done to the land or owner by reason of the condemnation. In the matter of an appeal to the United States Supreme Court by the owners mentione: it is understood that the Government is confident that the action of the Court in General Term will be sustained in every particular; counsel for the government contending that every ground upon which such an appeal is based has been covered by decisions of the Supreme Court, 00 —____ WORKING THE “RECORD.” WHAT MAY FOLLOW AS THE RESULT OF YESTER- DAY's DEBATE IN THE HOUSE. The discussion in the House yesterday in re- gard to the publication in the Congressional Record of the major part of Henry George's book, “Protection and Free Trade,” has aroused general interest here, both in and out of Congress, and the end of it is apparently not yet reached, The custom of allowing Con- gressmen to “extend their remarks” in the Record hus led to many abuses, chargeable to both parties in an equal dogree, but not within the memory of the oldest habitue of the Capitol has this privilege been perverted to extent of the publication of an entire book. The action of the House yesterday, in laying the subject on the table seems to practically authorize such pub- lication, and it is reported that some of the re- ublicans pose to retaliate in kind. Mr. oliver, who recently published one of Mr. Horr's letters in the Record, is under- un stood to have stated that he has a large amount of similar material, sufficient to cover sixteen or seventeen of the record, and which he now contemplates publishing therein. It is said that other republican members intend to publish in the Record the recent protection- ist work entitled “From Plymouth Rock to McKinley,” and also ‘Stebbins’ Hand Book of the Tariff,” and other standard high-tariff works, In the case of Mr. 's book there is no doubt that it was pub- lished in the Record with his full knowledge and consent, but the general publication of such works in this manner would, of course, raise an interesting and important question as to liability for infringement of copyright. ro George was quite willing to have his work thus distributed gratuitously, but other authors might not view the matter with so much com- lacency.
