8 ABUSED THE PUBLIC TRUST Present and Former Oity Officials In- dicted by the Grand Jurg, MOREARTY, MADSEN, TUTTLE, FLANNERY Results of the Grand Jury's Investigation Into the Condact of Muanicipal Affalrs During the Past Two Years—Court Notes, When the grand jurors reported in Judge Davis' court last Saturday they returned nino indictmonts. Any number of persons were anxious to know who wore the parties wanted, but Shorift Bennott kept the publ guessing untilfyesterday morning, whon at an early hour ho throw out his linos asd com menced to angle for his game. Ia this aneling ho met with remarkablo success, for ko landed four of his victims before the hour for opening court rolled around. Four Distinguished Prisoners, There was nothing unusual about the ap- poaranco of things in the large court room when tho bailiff announced that the court was ready for tho transaction of businoss, 1'rank Moores reaa the docket of Saturday’s procecaings, tho loungers dropped in aud took seats while four men, Councilman Thomas I, Tuttle, ex-Councilman Morearty, ox-Councilman B.'F. Madsen aud_ex-Street Commissioner Flannory occupied seats within the rail. Thoy looked at_tho carpot, the gas fixtures, the court and then at each other. After the routine business had bben trans- acted County Attornoy Mahoney stated that he had some matters to present to the court Tho audience strotched its neck and turned its listoning ear that it might catch every word of tho conversation. The court annouuced that it would hear Mr, Mahoney Mr. Tuttle First to Plead. Councilnan Tuttle was invited to & posi- tion directiy In front of the court, when tho indictment” of the grand jury was vead. It chargea that Mr. Tuttlo was™ a _mombor ot the city council and also a stockholder, an agent and gonoral manager of tne Silicon Wall Plaster corpany ; thut whien o membor of the council_and also n momber of - the plaster company he had iterested himsolf in a contract with the city of Omaha, contrary 10 law and contrary to the provisions of the ordinances of tho city, He had furnished material whict was used in a hall. “To this, what do you plead?” court. oot uilty,” responded Councilman Tat- o. asked the he bail, then,” continued the court, ‘‘is fixed at £1,500,” Mr. Tutile stated that he had a bondsman. Johu H. Butler stepped to the front and signed a paper, in which he guaranteod that Mr, Tuttle would be present when his case was called. That Bogus Ex-Councilman 8. called, and (o him an eck of O, I, Ballou's, I". Madsen was next dictment, to which he pleaded *“not guilty,” was read. This in- dictment charged that Madsen had mixed himself up in the Ballou electric light deal: that on April 1, 1801, while he was a member of the council, he had met O. H. Ballou and to him had proposed that if thers was money in 1t he (Madsen) would vote to grant Ballou a franchise, To the indictment Madsen pleaded not guilty. His bail was fixed at £1,500 and the bond was signed by S. Jaonsen. The hisfory of this caso was given at a council investization and at that time the tesumony showed thut an ordinance was in- troduced grauting an olectric light company, of which Ballou was the president, certain rights und privileges. The ordinance was re ferred to the committee on gas and electric lights, of which Madsen was chairman, Thera 1t remained for several weeks. Ballou tired of waiting, and one dark night visited Mad- sen’s house, near Seventh and Pierce streets. ‘The two men talted about the ordinance and the franchise until nearly midnight. Madsen was not enthusiastic over the passage of the tho ordinance, but finally Ballou wrote out @ check, which in the Investigation ~ was ' kmown as _ an “April foo) check.” This check WAS for the sum of £00, and was accepted by Madsen, after which he made a report favoring the granting of the franchise. While Madsen was examining the check, Ballou piciked up the orainance and tho r. port and left the house. When ths ordinance reacbed the council it was defeated. Two Charges Against Morearty. Ex-Councilman Ed 1. Morcarty was caught on two indictments, to both of which he pleaded “not guilty.” Bail was! fixed at $1,500 1n each case and the jbonds executed by Andrew Murphy. The first indictment charges that More- arty went into a strect sweeping doal tosome extont. From the fall of 1800 until a few weeks ago C. E. Squires, the street sweeping contra tor, had a bill of several thousand dollars be- fore the conncil. It had been disallowed by the Board of Publio Works ani also by the council, the grounds being that Squires had not performed the work in accordance with tho terms of his contract with the city. The indictment sots forth the fact that on October 15, 1501, whilo Morearty was a mem- ber of the council, he went to Squires and offered to do some log-rolling for the bill. If he was pmid §2,200 he would see that 1t ‘was put into the November, 15801, appropria- vion sheet and allowed. Indictment No. 2 against Morearty impli- cates him in the Ballou deal and ‘charges that he approached O, H. Ballou for the pur- pose of demanding $1,500 for influence which would be used in eogineering through the councii the ordinance granting the Ballou company_un electric light franchise in this city. Charged with Shooting and Malfeasance, James Flannery wns also caught on two Indictments, to both of which he pleaded “not guilty. In the first the bail was fixed at $1,500 and in the latter at 8500, ‘The first indictment charges that Flannery ou the night of June 2, 1501, with intent to kill, assaulted Charles Bauers a policeman. The facts as published at that time were about as follows: Flannery was running u saloon at Sixteenth and Vinton streets, Ho drauk of his own Jiquor until he became druuk, after which be raisea a row. A call for the patrol wagon was turned in and Flannery was carted to jail, where he was released, On his way home he met Bauers, the offcer who made the arrest, and at once opened firo on him. The bullets flew thick and fast, but as Flaonery’s aim was bad, none of them took effect. He was ro'arrested and taken to jail, ‘where he remained until the next day, when the matter was smoothed over and the prose- cution was dropped. At the time Flannery admitted the skooting, but zlaimed that his rovolver was discharged merely by accident, ‘The other indictment charges that Klan- nery while acting for the city in the capacity of street commissioner became interested in work being performed for the city. He was the owner of a number of teams which were put to work upon tho streets, he collecting tho wages. District Court Dolngs. Jullus Altschuler was arraigned Judge Davis and ploaded not guilty to having attempted "to defraud ihe J. T, Robinson Notion company out of §,080 worth of dry goods nm( notions.
