THE HOWGATE CASES, WasniNaron, May 7. -The court In banc throogh Caief Justice Cartls, dellvered a discussion fin the two Howgate cascs. In the first case, where the property had been attached by the government which it was alleged had becn held by Howgate to other partles, although the deed was not recorded, the court decided adversely to the government and dis- missed the attachment., The second case was an appeal from the adverse deoislon of the lower court where the defendant had resisted the attachment of his property by the government be- oause the action had been brought by speclal counsel inatead of the Unlted States dlstriot attorney. The appeal waa dismissed and the declsion holds. The United States has a legal right to employ such professional aid as it may deem necessary. RAILRQAD REGULATION AFFIRMED, The supreme court decision ren- dered in the so-called ‘‘granger case of Neal Ruggles agalnst the people of state of Illinols, in which the question is ralsee whether a charter granted to the Central Military Tract Rallroad company, now the Chlcago, Barling- ton & Quincy rallroad, by the leglala— ture of Illinols In 1856, or any sabse- quent amendment therefor, contains such contract between the state and company as to authorize the company to establish {ts own rates of faro and freight beyond Interference by the state. The court answers this ques- tlon in the negative, and hold the directors of the rallroad company can- not adopt apy by:law fixing rates of fare ant veight wiich aes’n it tiict with the laws of the state relatlng to the same subject. The judgment of the supreme court of Ilinois is af- firmed. On the 6th of March, 1883, Morgan A. Lewls, passenger on the train of the Ohicago, Burlington & Qalncy rallroad company, tendered Neat Rag- gles, a conductor of that company, 18 cents as fare for his transportation from from Bada to Neponset, a dis- tance of six miles. This was at the maximum rate of three cents per mile prescribed by the statute of Illinois then in force. The cenductor de- manded 20 cents, which was the fare fixed by the rallroad company. Lawis refused to pay more than 18 cents azd the conductor thereupon attempted to eject him from the car. For this act the conductor was prosecuted before » justice of the peace upon the charge of assault and battery and fined $10 and costs. The case was then carried up through the state courts by suc- coseive appeals, the rallroad sustalning the cunguemr. and raleing, the ques- tlon of the right of the state to iater- fere with its business by fixing rates of fare and transportation. A decls- ion was finally rendered in favor of the state by its highest court, and the railroad company thereupon appealed tothe supreme court of the United States, upon the ground that the act of the general assembly of Illinofs ot April 15, 1867, fixing the maximum rate of charges for transportation of passengers on rallroads in the state, ‘was unconstitntional and vold, be- cause it impalred the obligation of contracts in the charters of various companies which were merged into the Chicago, Barlington and Qaincy rusllrond company by the consolida an, The court holde: First —That the grants of Immunity from legitimate governmental control are never o 'be presumed. Downton, appellant, against Yeager Milling company, which involves the question of the validi:y of the patent on what is known as the new process for making flour by crushing graln between two rollers. The court holds the patent is vold for the want of nov- elty tha process which the ppellant claims as his inventlon having been clearly described as early as 1847, in a publication called ‘‘Anglo Day American and Swles Science Milling,"” by Ohriitian Wilhelm Fritsch, of Lelpsic. The decree of the olrcuit court dismisslng the bill is affirmed. After reading over oplnions ina large number of cases, most of which, however, involved only questions of local or private laterest, the court ad- journed for the term.
