It is but simple justice to Sheriff Rushmore, after the strict- ures passed npon him in regard to the delinquencies of his subordinates, to state that he has at last given effect to Governor Robinson's quarantine order in such 8 manner that no charge of negligence can now be laid at his door. One result of the conference be- tween him and General Patrick on Wednesday was that no person shall be admitted within the enclosure ELEMENT—THE STRICTLY EN- without a permit from the General. To facilitate business the Sheriff was author ized to issue permits to stablemen employed in the yards. The deputy sheriffs were at their posts, not only at the gates, but through the yards and around the stables. Under Sheriff Rushmore remained with them the entire day, after having been up all night. There was very little business at thg stables, as no cattle were removed. The on! Haence that. business was not entirely someshel was furnished bythe crowd of boys that collected with their little wagons and wooden pails outside the fence to receive the swill from the “shoot” lead- ing from the vats within. The number of cattle remaining in the stables is 218, of which te; have been condemned. The stidden influx of the Blissville cat- tle in addition to the ordinary busincss, has filled the jouses to their utmost capacity, Ono portion of General Patrick’s order in regard to cattle transit in Brooklyn, has given rise to complaints on the part of cattle owners in the interior of Long Island, who regard the operation of the order in its present state asa grievance. The only depot designated for ciittle is at the foot of Broadway, in the Eastern Dis- trict, and while this location may be convenient for cattle drovers in Brooklyn and New York, it will be embarrassing to owners of cattle in the interior ot Long Island, who would be properly accommo- aged by a depot on the confines ot Williamsburg. As the rule now stands, cattle coming from the mid- Jand section of the island must be driven down Broadway to the dock. DR. LAMBERT B: AILED, Following the recent it decision of the Court of Ap- peals granting a new trial to Dr. Thomas 8, Lam- bert a motion was made yesterday to reduco his bail from $25,000, in default of which he has been con- fined in the Tombs since January 2, 1878 The mo- tion was made before Judge Barrott, in the Court of Oyer and ‘Terminer, and gave rise to quite o long argument, Mr, Abram Wakeman appearing on behalf of Dr. Lambert and Distriet Attorney Phelps in opposition. Mr. Wakeman sgatmaedt et under the decision of the Court of Aj Dr. Lambert was entitled to his discharge. Phel imed that the decision simply meant that the ie of the lower Court was nugatory and that the prisoner must be tried over again. Judge Barrett said that he was satisfied that he could not discharge the pris- oner, as the decision of the Appellate Court was not — but simply entitted the prisoner to a trial de mtr. Phelps then said thot, under all the cireum- stances of the care, he would not object to the bath being fixed at $10,000, which was the amount before the conviction. Mr. nan insisted that this would be no reduction practically of the bail, as Mr. Lambert could not turnish it. He urged that as the matter stood the Court ought fo allow the pris- oner to go upon his own recognizance or upon noi nal bail. The examination of James M. Cosgrove, chief deputy marshal of the Eighteenth Assembly district, charged with having verified false certificates of the deputy marshals for performing services on election day which they did not perform, was resumed yes- terday before United States Commissioner Lyman, A large number of witnesses were examined, and the testimony was mainly a repetition of evi- dence previously given, James M. Turner testified that he was aid to Chief Deputy Cosgrove; that his special duty was to go around aud see that the deputies were attending to their duties; he had faithfully done so, and he had no occasion to report any one as neglecting his duty, and so reported to Cosgrove. He further testified that on election day Cosgrove acted in a sort of w semi-judicial capacity ; that he heard cases; that ies were brought to him for examination, a: those cases which he thought required it he sent to his chief—Inspector Davenport. vara “Then Cosgrove,” Interrupted Judge Dittenhoote “was a sort of district judge and Davenport was Chiet Justice.” “That was about it,” said the witness, ‘The case of Cosgrove wax then closed and argu- ment of counsel setdown for Saturday next. The section of the General Sessions Court over which Judge Gildersleeve presides was again thronged yesterday with Italians interested in the trial of Michael Marmora, o ragpicker, who was charged with the murder of Michael McDermott, Pierced to the heart by a stiletto thrust McDermott was found in the hallway of No. 18 Roosevelt street by Oflicer Sparboro, of the Oak street police. He dicd Before he could give any testimony as to how he received his death wound, and William Burke, his companion at the time of the stabbing, was too drunk to be able to say how the deed wasdone. On the first day of the trial it was shown that Michael Marmora, the prisoner, had a stiletto which might haye inflicted the wound, and that he was in the hallway where the stabbing was done cither at the time or within afew minutes of the fatal occurrence, ‘The testimony of Bulio, who lived in the house, and ot Michael Rofreno, who owns the slop beer saloon into which the men went to get their last beer after adrunken day and evening, showed that Marmora ‘was the only ove of the colony ot Italians inhabitin, the house who was in the hallway when the d must have been committed. On the open- ing of the court yesterday morning the prisoner took his seat beside his counsel, ‘Mr. F. Kintzing, prepared to present his defence against the ugly facts testified to by the witnesses for the people, ‘Mr. Kintzing, in his open- ing, claimed an al jute acquittal tor the accused. Marmora was Saad on the witness stand ‘and ad- mitted having been in the hallway, os described by the witnesses tor the people, but denied all xnowi- edge of the crime; he said that he went to pesokiya: to visit one ‘Tuozui, who has a grocery at No. 43 Adams street, Brooklyn, an old friend, who paid his ‘passage to this country, and for whom he occasion- ally did odd jobs; he was in the cellar splitting kindling wood to start a fire when the police came in and arrested him. Early in the present week a bench warrant was received from the United States Disfrict Court of Wyoming Territory for the arrest of J. M. Pattee, L. Ludlam and one Brown, against whom indict- ments had been found for “misusing the Post Office establishment” at Laramie City. It is pon indictment that the accused devised, with the i tention to detraud, a scheme known as the Sem- inole Gold and Silver Mining Company, under the laws of the Territory of Wyoming, “and falsely represented and advertised the said company to bo organized for the purpose of mining and to be the owner of rich mines and valuable machinery used to work and develop the same, situated in the Seminole Mining District, in Wyoming Territory,” and that thoy falsely advertised the stock of this ‘company to be of value, and for this purpose made use of the Post Office at Laramie City, contrary to the laws of the United States. Without issuance of warrant Pat- teo, accompanied by his counsel and ex-District At- torney Bliss, appeared before United States Commi: sioner Shields and was formally committed to await the action of the authorities in Wyoming.
