hejecone or ne cana sare on ne 1300 November, ‘Taylor presented a communication from W. B. Cooper, be Ragaad neer, recommending that an alteration be in the mauner of constructing the enlargement of mplain Cansi by substituting vertical wally for slope alls between Nos. 2,300 and 2,325 (survey first division), d offered the following :— ‘Rosolved, Tht the alteration in the manner of construct- Ging the enlargement of the Champlain Canal between tutions Now, 2.900) aud 2.925 (survey of first diviston) , th fy recommended by W. B. Cooper, division engineer, be ladopted, the expense of the Kaine uot to excood $7,225. On calling tho yeas and nays the resolution was jadopted. The result of this proceeding on the part of {the Caual Boars was to retieve the contractor from his ligation to construct 2,000 cubic yards of slope wall & cost to the State of only $1,000, and replace it by Structure such aa we have described, at an expense of 17,188 86. What Mr. Cooper's reasons were which uiuced the Board into this strange deviation irom the rovisions of the statute we cannot tell; they have not wen recorded in the miputes of the Board. The Cans ‘ommissioners seem also to have been yequally indfifereut to their obligations. After letuing (the contract to Demwon, they do not appear to have given ita thougist, except to issue to him their war- Fants from moutt to month, predicated upon the esti- mate of the engieer, whereby he was enabled to ob- ‘ain the money fromthe State treasury. They seem to uve overlooked the {act that they are specially charged fo examine frequently and carefully into the state of | fehe camuls and works committed to their charge,” aad To superintens and cause to be made such extraor- ‘divary repairs or improvements as may be ordered.” If such “frequent and careful examinations” and enperintendence” had taken place how very soon the ‘fraud of the engincers would have been discovered and ‘timely correction made. We do not believe that it was ‘ever intended tliat the responsibility of the State Engi- eer should cease when he had signed the plans and esti- douates submittec by him to the Canal Board. In our opin- Yon a direct responsigility rested upon trim throughout the prosecution of the work and until he had examined and passed upon the final account, Mr. ex-State Engi- meer Taylor's \estimony upon this point isso much at ‘variance with our views that we deem it best to include At in this report, The report here refers to the testimony of ex-State Engineer Taylor, which 1s so much at variance with the views of the commission that an extract from such Westimony is published. The report then continues:— It is only justice to Mr. Taylor to state that this con- @ract was jet in July, 1871, and he did not assume office iil January 1, 1872.’ Nearly all the work under it, how- ever, was prosecuted during his administration, the jcontractor being unable to commence operations till j@fter the close of navigation, in December, 1871, He estifies that he disciplined Mr. Babeook in the winter lef 1872-8 by dismissing him from the service of the Btate for hia counection with the original survey, but be failed to bring the matter to the attention of the Cunal Board, as required by the following section of the Jaw (see Chapman, section 857) :— When even the State Engineer and Surveyor or either of tbe Canal Commissioners shall suspect any fraud or miscon- uct on the part of any engineer or assistant in relation fe the public works, it shall, be his duty to report t! ame to tho Canal Board, who may employ so many and Buch agents and engineers as they may deem proper to ‘aid them fo the Investigation of the matter, and draw on the ‘Treasurer, on warrunt of the Auditor, for their compensation and the éxpense of the investiga If this had been done in Mr, Bubcovk’s ease, the fraud in the exbibit shees fwould have been brought to the notice of the Canal Board Melore the final settlement with Denison was made, Of Mr. Crocker’s action relative to this contract, we ean form no other opinion than that he knowingly and wilfully falsified his estimates, thereby entailing great Yoss upon the Stale to the corresponding profit of the sontractor Denison, JOHN BIGELOW, DANIEL MAGONE, Jp., A. E. ORR, JOHN D. VAN BUREN, Jr. Aunaxy, Oct. 6, 1875, Chap. 788, Laws of 1870. Chap. 783, Laws of 1870. THE COURTS. TOMBS POLICE COURT. Before Judge Otterbourg. ALLEGED SWINDLING. \ M. Vaulhetm, of Saratoga Springs, was yesterday ar- Faigned at the above-named Court on a charge of awindling, It was alleged that in September, 1874, the prisoner called on the firm of Becker & Lyser, jewel- ers, doing business in this city, and represented that he was worth considerable property in Suratoga and was proprietor of a store under the Union Hotel in that town, On the sirength of these representations the firm named gave him goods valued at $2,190. It was subsequently ascertained that Vaulheim was heavily in debt, and had made over all his property to his wife, Henco his arrest. Another compluint of a similar na- ture was made against Vaulheim by Alfred Nicholls, of No. 8% Division street, whom ho is accused of hay- Sng swindled out of $755 worth of property, ‘Tho prisoner was held m default of $2,000 bail to answer. FIFTY-SEVENTH STREET COURT. Betore Judge Kilbreth. A MODEL POLICEMAN. Bernard Conway, of No. 410 East Nineteenth street, Decame involved in a difficulty last week with Michael Kelly, a waiter in the Clarendon Hotel. Blows were exchanged and Conway got the worst of the encounter, He was determined, however, to have satisfaction, and sought for that purpose the aid of his brother, who is a policeman attached to the Fourth precinct. On Satar- day night Kelly was in a shoe store on Second avenue, when the two Conways entered, The proprietor of the store, who knew them, objected to their presence in his lace, and Oflicer Conway drew his revolver to enforce Bis authority mm arresting Kelly. The Court thought “‘the arrest was vory irregular, to say the least,” and eaid a warrant should have been obtained, The prisoner was therefore discharged, The oltcer will have a eharge preferred against him by the proprietor of the shoe store. POLICE COURT NOTES. Michael Burnes was held to answer yesterday by Jus- tice Otterbourg, at the Tombs Police Court, on com- plaint of Victor Fisco, of No. 191 Grand stroct, who | charged that while passing the corner of Grand and | ‘Mott streets he was assaulted by Burnes and another aan and robbed of $4 and a gold ring. Edward Luther, of Old slip, was Lcld to answer for eelling lottery policy tickets. Officer Musgrave, of the Fourth precinct, on Saturday night arrested Matthew Ryan for intoxication, On avarching him at the station house a yold key and a wire pick such as burglars uso were found in his pos- session. The key was identified by Mr. Stone, of No, 145 Chatham street, us a portion of the property stolen from his store on Saturday last. Ryan was held for | rial. i Thomas Cox arraigned before Judge Wandell at | the Washington Place Polico Court yesterday, and held | 1 $800 bail to answes on a charge of assaulting John H. Button, of No, 1 Thompson street, and attempting to rob him. COURT CALENDARS—THIS DAY. The Commissioners of Charities and Correction have passed a resolution doing away with the Park Hospital. ‘Yue removal of the beds and other furniture to Belle- yue Hospital was commenced on Saturday and will be finisbed this week. The Park Hospital was instituted by order of the Mayor and Commonalty of the city some four years ago. It was then destined for the re- ception of sunstruck patients, but gradually all kinds ‘of surgical cases arising from accidents to persons in | the lower wards of the eily were treated there. ‘The building was an old one when the hospital was first established in it, The walls are cracked in several piaces and bulged out of their proper line. The acci- dent at St. Andrew’s clurch aroused the Inspectors of Buildings to more careful action in their department, and tie Park Hospital building was inspected. On the 17th of last March it was reported as unsafe, It was decided to remove the patients if they could use some other building in the lower part of the city. The De- partment of Public Works, however, had no power to select another building for the hospital, and the one in the City Hall Park continued to be used, notwithstand- ing its dangerous condition, At last the Commission- ers, not wishing to endanger further the lives of all its occupants, have decided to remove the hospital to Bellevue and for the present, at least, to give up the idea of having a hospital in the lower part of the city. ATTEMPTED SUICIDE. Mrs. M. Burnett, residing at No, 5 Duf™ield terrace, Brooklyn, jumped out of a second story window of her apartments at half-past one o'clock yesterday morning, fracturing her right ankle and spraining her back.
