At length, after several days’ waiting and delib- @rating upon the subject, Chief Justice Daly, of the @ourt of Common Pleas, bas given his judicta! views upon the Sunday amusement question, His views he embodied in an: opinion rendered yester- @ay on the application recently made before him on behalf of Adolph Neuendorff, proprietor of the Bradt Toeatre, for an injunction against the Police Commissioners, restraining them from interfering with bis giving performances at nis theatre on Bunday evenings. As will be seen, he declares the act under which the Police Commissioners have proceeded constitutional and denies the applica- tion ior an injunction. .The following is bis epinion :— OPINION OF CHIEF JUSTICE DALy. It is claimed that the act 1s unconstituttonal, because itis local act and the subject of it is DO, as the constitution requires, expressed tn its title. It 1s entitled ‘An act to preserve the pub- hie peace and order on the firsce day of the week, commcnly called Sunday,” and the subject of it 1s the prohibition of public theatrical perform. nces on that day in the city of New York. A statute designed to preserve the public peace and order upon a Sunday need not in its titie express what is proxibited in the act, with a view to that end, lor if tnat were so everything probibited Would have to appear in or be expressed by the title, Woich would be absurd. It is sulficient if that Which is forbidden to oe done comes within tue general purpose expressea in toe ttle, the preservation of public peace and order, and con- sidering this to be the rule of interpretation how can this Court declare, judicially, that the pro- bibiting 0: pubic theatrical performances 12 this city on Sunday does not and cannot in any way canouce ro the (ei bined Ol peace and arder upon that day? In Those cities, When the morning religious service \ over im the churches, all parties are free to work, labor, trafic or amuse themseives as they think proper; but 1n our cities the great bulk of the communtiy attend public worship not only in the Morning, but in the atrernoon, or else tu the evenng, so that by a very large class tne day is observed throughout a8 a day of religious obligation and duty, while to all it is 8 day Of rest irom their ordinary employments, and, it they make itso, of quiet and repose, It 18 ‘this Weil knoWn feature which gives to the Sunday with us @ characteristic element o/ order, sutti- vientiy distinguished and understood to indicate pede what 18 meant by the [Reap acing ot or- ler on Sunday as expressed in the title to this act. Previous jaws have jorbidden all work and lavor DO that day, except works of necessity and char- ity, but il the theatres are opened for the giving bi public periormances, the actors and all em- ployed 10 giving them violate the statutes forbid- aig Work and labor on Sunday, and an element oft vider which it was the design of these stat- utes to maintain is disturnped. There 1s, therefore, a Jeature of order which 1s preservea by keeping the theatres closed upon Sunday, and that being the object of the act it 18 eXpressed by the title. ‘The objection that the title does uot express that the act 13 limited to bhe city ot New York 1s not welltaken. All that the constitution requires is that if the act be a local act the subject o1 it shall be so expressed in the title. The subject of tne act is distinguishable rom its local operation, and it is the fact of ts local operation, ascertained by inspecting she body of tne act, Which renders it void if the provision of the constitution has not been com- pled Witp. Judgment most therefore be rendered for tae defonaant, i (NTERESTING TO IMPORTERS OF JUTE. ————— The case of Stokes vs. Recknagel & Co., ts one w those that affect largely the interests of a large dass Of merchants in the city. The action was wiginally brought to recover a sam of $25,713 48, mM gold, theiprice of 2,000 bales or jute butts, sold by the plaintiffs through a mercantile house to the fefendants, to arrive per ships Taypore and Nag- pore. The contract of sale speciiied the price per pound, actual gross weight, as landed alongside wip in New York or Brooklyn, duty paid; and aiso jrovided that the buyers should have the benefit of any redaction of duty and pay any increase of the same. The goods arrived in June, 1872, and a act of Congress, reducing the duty thereon, was © go into elfect on the 1st day of August jollowing. Immediately on arrival of the goods the deiend- thts Were notified of the iact and askea whether they wished the goods put in bond. They said shey did to obtain the benelit of the reduction of the duty. An urder on the vessel for tue delivery pf tue goods was sent to the detendants, and they replied that all they cared about was the question vi weight. The butts were put in bond and a storage receipt issued to the desendants. On p! sentatidn of the oll for $25,713 48 the aesendants made various objections, not relating, however, to the non-payment or duty, which were obviated. The cause was tried by Mr. D. McMahon and Mr. W, A. Ex-Alderman Odell claims to be the victim of unioriunate circumstances, He keeps a sale and exchange stable in East Twenty-fourth street. A few nights since, an otter tur robe, some dozen laprobes and about twenty pairs of horse blankets, the préceeds of a piliering pilgrimage among gentiemen’s stables were found in the hay lo(t of his stable. He was arrested on a charge of receiving stolen goods, taken belore Judge Murray and in default of $5,000 bail committed to await the action of the Grand Jury. A writ of habeas cor pus having been obtained by Peter Mitchel, hig counsel, he was yesterday brougat belore this Court and bis discharge asked. His counsel urged that there was no evidence on which he could be helt, and proceeded to state that when the stolen property was found five men were discovered asleep on the haymow and four others entering the place jor like somno- lent purpose; that there was no conceulment of the goods; that he-(Odell) knew noining of the gvods being there, and that he had not been in the tayloft lor two months and only twice in the stable for ten days before his arrest. It was eon- tended that an indictment for receiving stolen could nog be sustained without proof of an actual pan ey | into possession, It was stated as a further hardship on the prisoner that he was kept thirty-six hours at Police Headquarters before being taken before a magistrate. Simpson was arrested in a civil sult upon an order of arrest issued by Chief Justice Daly on complaint of Emil Naas, the charge being that Simpson had abstracted about $12,000 of piaintif’s money while acting as bis general nt. A motion was made to vacate the order of arrest, and on this motion a reference wus or- aered to examine plaintii’s booke, On the ree eree’s report a motion to discharge the defendant was made ana arguea at length by ©. N. Brooke for the defendant and Charies Wehie jor the plain- tif, a8 also @ motion by the plaintiff to vacate une referee’s report. Upon this Judge Larremore made an order granting the motion fo vacate tue referee’s report and denying the motion to vacate the order of arrest, and also directing the de- fendant to pay to plaintiff the costs of motion and disbarsements on the reference. To give more explicitness to the case Jadge Larremore, in ad- dition to the order, tas written the following opinion: ‘Lae practice is well settled that when the ground of the arrest constitutes or tends to constitute the cause of action, a bare denial of the plainti’s allegations in this respect will not per se, nothorize the delendant’s discharge. Tne onus im such a case is upon the applicant to show that he has an undoubted detence on the merits, which will be certainly established on the trial. John grabbed {it and left the house, nor did he tarn until be was inside the hotel. When he got tnere he found that there was only $160 instead of $260 in the paper.
