Mr, Storey's Case Comes Tp in the Criminal Court Hessrs. Reed and Asay Disenss tho Soundness of the Indietment. The Court Decides the Objec- tions to the Grand Jury Invalid. But Hints that a Man Should Not Serve Continually Thereon. Mr, Asay then Moves to Quash the Indictment. It Does Kot Allege that the * Times* Circulates in €ook County, The Present Grand Jury Returns Two More Indictments. One Is for Attacks on Sam Ashton; the Other on Tom Lonergan. The Matter Comes Up Again on Monday. ARGUMENT ON THE DEMURRER. THE STATE'S ATTOBNEY SGSTAINED. The arguments on the demurrer of the State’s Attorney to tie pleas in abatement filed by Alr. Aeay, counsel for Wilbur F. Storey, in the Fair- back libel case, wero made bofors Judge Tree, »itting in the Criminal Court, yesterday morning. The discussion was to have commenced at 10 o’clock, but, Mr. Asay bemg engaged in the Cir- cuit Court, did not make his appesrance until a quarter after 11, when the Conrt was about de- forring tho matter until Mondsy. The counsel present were Suta ‘s Attorney Reed, Mr. Sidney Smith, and Judgs Trumball, who Tepresent Mr. Fairbank, Mu. REED opened the argument, saying that at the Iss term of the Court the Grand Jury presenied an indictment against Mr. Storey for libel, and his consel had filed three special pleas in abatement, alleging that the Grand Jury was illegal for cor- tain reasons. THE FIRST PLEA was that the Grand Jury was not selected by the County Commissioners, that the venire was not put into the Sheriff’s handa ten days befors the commencewent of the term, and that it waas no properly made to the Court to appoar that the causs of justice demanded 2 special venire. Tho latter was an averment that was not traversablo ; the record in the case recited that, on the 27ta of October, it appeared to the Court that the cause of justice required it, and theroforo a special venire was ordered. The revised statates provided thet ““ the Judge of any court of rac- ord may order a special venire to be jssaed for a Grand Jury ‘at aoy tims when ho shall be of opinion that public justice requiros it.” That dispoeed of the first plea. THE SECOND alleged that one of the jurors, Reuben Taylor, was over 60 sears of age. As a comploto and conclusive answer ho read the followiug from the statute : ** No indictment shall be quashed for want of the words * with force of arms,’ or of the occupation or residence of the accused nor by reason of tho disqualification of any Grand Juror.” It might be said that the matter under consideration was not a motion to quash ; it was, howevor, the eame thing in effect, and if the demurrer were overruled and tho plea there- by sustained. the indictment would bo quashed. A man over 60 years of age was not dizqualified, and it had been B0 decided in the case of Murphy va. The People (37th IIl.), the Supremic Court holding that the factcould simply ba urged 2s o personal exemption by the juror when presented. No provision was mada for challenging Grand Jurors; the stat- ato mentioning only Petit Jurors; and the 1aw now was the same as whenthe Murphy case was decided. The Legislature, evidently, from its language, did not intend that any such enal- lenge should be allowed in ti case of Grand Jurors as in the case of Petit Jurors. Ie con- ceded that the array of the Grand Jury might bo challenged for certain causes, but that was ot the question before the Court.
