Judge Larremore, hoiding Special Term of the Court of Common Pleas deuiedt yesterday, as will be seen in his published opinion in the case given in full below, the application tov a mandamus against the Board of Apportioument made on behalf of the clerks of the d1d Bureau of Eicctions. THE OLD BUREAU OF ELECTIONS. First Disposal of the Application for a Peremptory Mandamus Against. the Board of Apportionment—The Appli- Cation Denied by Judge Larremore— His Opinion in the Matter. The old Bureau of Elections, with Cornelius ‘Corson as its chiet, and tive clerks under him, be- sides a stenographer and messenger, had, to bor- row a modern phrase, ‘a soit thing of it.” Corson, the head and iront o! the Bureau, received $6,000 salary, and the clerks and sothers were propertionately well paid, the aggregate of the annual pay roll being $22,500. In April, 1870, the Bureau was organized, and, with a single excep- tion, everything went on swimmingly—that 1s to Say, With very little to do, except to draw their sal- aries, until by enactment its onerous duties were transferred to the Police Department. The ane exception referred to was that after January 1, 1872, the Comptroller reiused to pay their salaries on the ground that no appropriation had been Made. Under this state of allairs the claimants sold their claims, amounting to $10,752 61, to Patrick McMullen, the first clerk, and the latter, having exhausted his powers of persuasion upon the Comp- * troller and Board of Apportionment, thought he ‘would try what; virtue tnere was in the law. He applied for a writ of peremptory mandamus against the Board of Apportionment, directing it to appor- tion the sum required to coyer the claim. The case went first before Judye Larremore, holding Special ‘Term of the Court of Common Pleas, and then be- fore Judge Van Brunt, oi the same Court, and finally before Judge Larremore again. The latter judge ‘brought the case toa close yesterday by denying the epucRnce. His reasons for so doing are em- bodied in the following opiuion :— OPINION OF JUDGE LARREMORE. When this application was first heard before me direc- tion was made that the respondents meet and take ac- tion upon the relator’s claim. By the return tiled it ap- pears that such direction was complied with, and that said Board, by the concurrent votes of all its members, decided that no authority existed to propria: tion asked tor. ‘This claim occurred 2, but Mo appropriation was made tor its spay ‘ment by the Be of Apportionment for that year. ‘The main question pre- sented for adjudication is whether the existing Board oi Estimate and Apportionment, created by the Legislature ‘of 18/3, can be compei-ed vy’ mandamus to make an ap- ropriation to meet such claims. By un act of the Legis- Lature, spassed April 19, 1s71_ (chapter 683), a Special Bou Apportionment’ was created, consisting of the Mayor, the Comptrolier, the Commissioner of l’ublic Works and the President of the Department of Public Parks, who were directed to fix the amount to be raised by taxation in the years 1871 and 1872, and, after setting @partso much as would be necessary to'pay the interest on ¢ public debt, State tax, 10 apportion the remainder, thereot among and set apa: to the various departments of the city and count rnment. The intention of the Legislature to have tne amounts so raised and appropriated (in the years 1871 and 1872) fixed and determined by a special authority, is thus clearly . The existing Board ot Estimate and Appor- tionment, composed ot the Mayor, the Comptroller, the President of the Board of Alderman, and the President of the Department of Taxes and Assessments, is another and different Board than that created by pe Ce Peat) of 1871, The authority to ax and ap- propriate #he moneys to be raised by taxation for county Purposes, presented and controlled (chaper 873, Laws i871), the Hohe tet of which, so far as they might affect the apportionment for the years 18/1 and 1872, were re- pealed by the said chapter 533 of the Laws ot 1871. It 1s evident that the respondents have just succeeded to the rights and duties of ihe special Board created by the last mentioned act. No such authority is expressly in- ferred by the statute, or can be iuirly implied theretr Having reached this’ concinsion it is unnecessary to upon the other questions raised upon the able and ¢ hanetive argument of counsel. ‘The application for w per- emptory mandamus should be denied. BUSINESS IN THE OTHER COURTS. SUPREME COURT—CHAMBERS. Sherif Brennan’s Fees and Rent of the Ninth Regiment Armory. Before Juage Pratt, Returns were made in this Court yesterday to the alternative mandamuses against the Comp- troller—one on behalf of Sheriff Brennan, claiming $52,000 Sheriff's fees for the first three-quarters of 1872, and the other on behalf of Charles H. Johnson for $27,000, rent of the Ninth Regiment Armory, corner of Twerty-seventh street and Ninth avenue, Mr. John 5, Strahan, counsei for the relators, ob- jected to the returns made as uot sworn to, and moved that they be stricken out, unless the Comp- troller swears to them. Mr. Carter, counsel for the Comptroller, argued that there was no law to compel the returns to be sworn to. Mr. Strahan said that whenever application of this character is made the Court exercises its dis- cretion and orders the returns to be sworn to. ‘This was done by Judge Barrett in the Grant case, He had special reason for making the application, for the Comptroller comes into Court by these re- turns, and makes statements over his signature which he wouldn’t make if under oath—amongst ‘Others that the Board of Supervisors did not audit these claims of the Sheriff. ‘It was finally arranged that the counset submit briefs to-day embodying the statutes on the re- ‘spective points raised, The Case of Annie Rosenberg. Annie Rosenberg, a pretty looking girl, about fifteen years of age, was brought into Court on a writ of habeas corpus and certiorari, by Mr. Ans- Dacher, who asked for her discharge from the House of the Good Shepherd, on the ground of dis- crepancy between the commitment by Justice Shandicy and the return made to the certiora The commitment stated that the girl was sone t0 ‘the institution named on her eonfession that she ‘Was a prostitute, and the return to the writ, made by a person named Abraham Marks, who lives in Street, was that Annie is his niece, and that she bad been living with @ man not her husban Judge Pratt, remarking that he could see nothi inconsistent between the statements, ordered t! writ to be dismissed, A Lawyer Loses His Papers, ‘The case of Novarro vs. Green, which was amo. ‘tion to quash an alternative mandamus against the Comptroller, granted by Judge Fancher, ordering him to show cause why he should not pay $300,000 for water metres supplied to the Department of Public Works, came up for hearing, but there wasa ‘fatal hitch in the proceedings. Empannelling of the Grand Jury. Beiore Recorder Hackett. The Grand Jury was sworn in yesterday. Roland S. Doty was appointed foreman, ani after a bricf charge by the Recorder they entered upon the discharge of their duties. Before the Court ad- journed in the afternoon the Grand Inquest cane into Court witha number of indictments against prisoners charged with burglary and grand larceny. This prompt action on the part of the Grand Jury will enable the Recorder and the prosecuting ofticer to dispose of all the prison cases in a few days. Youthful Highwaymen Sent to the State Prison. John Moore, Thomas Fullam and Thomas Miskell (youths), who were chi Steffan of a silver watch on the 4th of May, valued at $8, ina hallway on the Tenth avenue, pleaded guilty to peity larceny trom the person. Moore and Fullam were each sent to the State Prison for five years. Miskeil, who was only seventcen years ol age, Was sent to the Penitentiary jor the same period. An Attempt at Burglary. Adolphus Lohman and George O’Keefe on the night of the 12th of April effected a burglarious entrance into the Jewelry store of Charles Runkel, 495 Ninth avenue, and stole a number ot silver watches valued at $273, O’Keefe pleaded guilty to an attempt and was sent to the State Prison tor two years. Assault with Intent to Steal. Patrick Manning, a youth, who was indicted for assaulting Albert Abrams on the night of the 10th of July and stealing from nim a silver watch worth $12, pleaded guilty to petty larceny frorh the per- son. The sentence imposed was three years’ im- prisonment in the Penitentiary. ‘Thomas Kelly and William Hannon pleaded guilty toa simple assault, the indictment charging that on the 7th of July they assaulted Daniel Sullivan in Water street, with intent to steal money and a watch. They were each sent to the Penitentiary for six months, Stealing Furs in Summer, John Rademacher, on the 4th of June,-pleaded guilty toan attempt atlarceny. He was charged with stealing a quantity ef furs from his employer, Sylvester Brush, on the 26th of March, and r manded to be used as a witness against the r ceiver of the stolen goods, who, it appears, died last week. Rademacher was sent to the Peniten- tiary for three months. A Fugitive Burglar Brought to Bay. James S, Smith, alias “Big Munday,” who waa jointly indicted with William Davis for burglary in the third degree, pleaded guilty. On the 26th of April, 1 they broke into the carriage factory of Edward M. Corbett, 214 Kast Twenty-sixth street, and stole silk and rep cloths and plated ware, the aggregate value of which was $800, Smith was ar- rested in a Western city and brought back to New York. He was remanded till Friday for senience, A River Thief Convicted. Stephen Dillon, who was jointly indicted with John Walsh, was tried and convicted of grand lar- ceny. The prosecution showed to the satisfaction ofthe jury that on the 23d of Jnne twenty-eight pigs of iron, the property of the Allentown Iron Company, were stolen from a dock in Hoboken, and that at half-past three on the same mornihg the prisoners were found in possession of this iron by two of the harbor policemen, who arrested them as they were approaching the pier at the foot of Houston street. Dillion swore that he bought thefiron ofa pe acai for $15, Mr. Mitchell defended fhe accused. The case was so clear that the jury rendered a verdict of guilty without leaving their seats. His Honor in passing sentence said that he was bouna, if possibie, to check the depredations which river thieves were making upon our commerce. Dillon got the full penalty, which was five years in the State Prison. YORKVILLE POLICE COURT. Alleged Arson. Emma Orlak, a young German woman, and her brother, have for some time past been occupants of @ suit of rooms on the first floor of the premises 1,142 Second avenue.
