NEW YORK HERALD, THURSDAY, J. ANUARY 3, 1861. —TRIPLE SHEET. —_—————— oases by hanging was repealed. The Governor ; signed this very singular bill, and it became the law of the State. He now proposes that it , shall be repealed, and that we shall return to the old law, which provides that murder in the first degree shall be capital- ty punished. The Governor believes that pub- r lio sentiment demands the restoration of the ~ death penalty, and it is quite certain that if some radicul change in this very imporfant branch of criminal law is really demanded the whole code must be revised. Since the Legis- lature abolished the death penalty the numbor of murders in cold blood has increased, and it oy is quite evident that the safety of the commu- s nity can only be assured by the onforce- > ment of the original provisions of the code. It may be that capital punishment is theoretically wrong; but society is not yet prepared for its entire abolition. We have seen all along that public sentiment was Opposed to tho abolition of the death penalty; and it is evident now, after the so-called hu- > manitarian code has been in operation a little legs than a year, that we were right in our first impressions. For the city of New York, with its dense population, constantly recruited from all paris of the eivilized world, we must have @ clear, strong, vigorous criminal code, and capable judges to administer it. This commu- nity has not yet lost its respect for law, al- though the stupidity of its legislators might well justify it in so doing. Give us good laws, and we will see that they are fuithfully executed. News from Havana. Within that period, however, soveral heavy failures have taken place,farising entirely from political causes. During the panic of '57 it is well known that the greatest defaults occurred in the West, and that the South was rolied upon with confidence, which the promptness of its payments shows was not misplaced. The Weat is just beginning to ‘recover itself, and the abundant crops of the last harvest would @oubtless have fully restored the prosperity of that seciion; but in the present unsettled posi- tion of affairs it is difficult to tell what the ond may be now. The Dill passed the Houso over the veto by more than a two-thirds vote, and will pass the Council to-day by abot 10 to 8. In that period of time no less than eight hundred and fifty-two houses have failed, involving the above amount; and when we consider the prosperous state of affairs up to a point within a month of the election, there can be no doubt whatever that this immense in- trease of commercial disaster is attributable to the political embarrasements of the country. If this political dificulty can be amicably adjusted, it is fair to conclude that within three months from this time the United States will exhibit a degree of commercial prosperity never ceen here before, and rarely enjoyed by any other nation.
