8 Brooklyn City News Duar ANp Convicrion oN THe CHARGE OF Bicamy.—The @ourt of Sessions has been occupied for the past two days a the trial of Dr. Richard M. Smith, a patent medicine vender, formerly doing business it New York, by Bed @etment for bigamy in marrying two wives. The novelty of the cage ja in the fact that the defendan} get up a third marriage with the view of showing thereby that he had pot committed bigamy within the strict meaning of the Jaw. The indictment charged that defendant married & Miss Adeline Smith, at Smithtown Branch, L. I, on the oth of June, 1841, aud on the 13th of August, 1857, mar- vied Migs Josephine Decker, of this city. Both ladies were n cougt and testified to their marriage to defendant, The iret wife had five children and the second one child. ‘The defence brought three witnesses, who ewore positive ly that thoy witnessed the marriage of this same defend L, by hariotte J. Weeks, of Cold Spring, L. ant to Mie CUtiwell pastor of the old Chryati purch, ia New where tue © ras, performed ing alier service, I the year i586 ‘amined the father, mottier, sister, brothers an died in 1837), and the facts el Weeks) was’ married to Mr they knew Smith; he had catied at ¢ pay aitentions to Miss We Dusiness; they were positive ‘that she Spring in company Ww mith to come any ume; Lever heard enly informed of the m. one year ago. No mention of ever Deen made by deceased during s member of the family, The defesce, assuming that the marriage of defendant with Miss ¥ hea been proven, contended that the second marriage with Miss Saith— which tock place in the lifetime of Miss Wecks—was null and vou; and Miss Weeks being dead, the marriage with bise Decker was legitimate, in whatever morality of the case might be viewed. Tz mitted to the jury about three o'clock yesterday after noon, dat as they were, possibly, unable co comprebend the justice of punisbing @ man ‘for marrying two wives, and acquitting him om the groind of marrying a third, they brought in a verdict of guilty, after a very few min wees’ deliberation. The defendant being arraigued for penteuce, answered the usual questions, to the ot that be was born in Smithtown, L. I., was forty years of age, and had no mechanical trade. He appealed wo the Court for lenienc: firmed ftolemaly that he was marcied ‘Miss Week#, but that having abanioned bin, he mar vied again, not taking into consideration the necessity of uring’a divorce, He was wrong in marrying the d wife, although be cid not mean to be; and, in con- eluding, he hoped that, for the fake of his children, whom he loved dearly, the Judge would make his sentence as Bight as possi! The Judge stated that all the circam. stances were of such a character as not to warrant the Gourt in showing leniency. It was plain that he bad sub peenaed witnesses here to swear to a marriage by which, 4 proven, the reputation of a virtuous family would ave been blasted. The verdict of the jury met bis hearty concurrence, and the sentence of the Court would De that he be confined in the State prison, at Sing Sing, for four years and six months. The amount of money offering by Danks and other lenders at five per cent on call, is in excess of the demand, and parties who have ba- Jances over are obliged to be satisfied with 4 a 4}. Btill, the rates for paper are maintained at the minimum of six, which occasionally includes a bro- kerage. Atsevenall good paper is readily con- Yertible into money. Single names range from 7 to 8. There is now every prospect of an extremely easy money market, at least for the next four or five months. The movement of coin at the Sub- Treasury continues sluggish; the payments to-day Were $312,547, the receipts $153,155, of which $128,- 00 from duties, leaving the balance this even- ing, $8,306,169. Foreign exchange is very flat. The leading draw- er on Paris has lowered his rate to 5.15{, at which figure the demand to-day was slack. Other draw- ers were asking 5.16] a 5.17}, and we hear of some Southern cotton bills going at 5.189, less a broker- age. First class storling bills wore sold at 103} a }; there are some good mercantile bills in market at l0sga}. Itis evident that the renewal of the specie export is deferred for the present. Next month we shall probably begin to get rid of some of the gold which is accumulating here. The following are the last quotations of sight ex- change on New York at the cities mentioned, the qnotation being in all cases for gold :— ‘Chicago a 4g promi St. Loui “ Cincinnati Mobile... New Orleans, Baltimore. Philadelphia, The stock market continues buoyant and ani- mated, and a further advance in prices has taken place. This morning, at the commencement of business, an order for three thousand shares of New York Central—supposed to be for Albany account—was executed by a leading broker; the consequence was an advance of two per centin the price. The stock reacted after the first board; in the afternoon it sold at 74}, closing that bid, against 72) at the close yesterday. The impression is general that whatever becomes of the Pro Rata and Tolling bills, the Central will manage to take care of itself, The business in this stock to-day was very large. Rock Island and Galena were likewise active, at an advance of about one per eent each; they closed to-day at 64} and 59} respectively, against 63f and 68{ at the close yesterday. Illinois Central jumped up to 62, clos- ing that bid, against 59f at the close yesterday. The recent advance in this stock will be likely to bring over some shares from England for sale here. It is doubted in many quarters whether the increase in the net earnings of the road corresponds with the increase in the gross receipts; much of the cotton and sugar carried from Cairo is transported at very Jow rates. The Michigan shares are well sus tained—the Southern by parties who are operating on the strength of arrangements lately made be- tween the Southern and the Grand Trunk; the Cen- tral by Boston friends of the stock, who natarally consider that their negotiation for the renewal of their maturing bonds will be assisted by an appa rent recovery in the market price of the stock. The earnings of the Michigan Central have not shown the progressive improvement exhibited on most of the Western roads; for February they were $107,748, against $102,959 last year; the traffic during most of the month having fallen short of last year. Michigan, the Detroit and Milwaukee will probably affect the receipts of the Michigan Central. Read- ing rose one per cent, closing 42} bid, against 419 | at the close yesterday. The demand for State ‘stocks continues very lively, and a farther advance was realized to-day in slmost all descriptions, Federal 5's advanced j, Tennessees $, Mixsouris 2, Californias j; these securities are being taken by | ‘the public (mostly at the South) for investment, and look as though they might rise mach higher, | Good railway bonds, as Galenas, New York Centrals, Erie firsts and seconds, Harlem and Hudson Rivers, are likewise much wanted. After the first board to-day the bear jobbers, who are nota little dis tressed at the turn things are taking, attacked the market with some vigor, and cansed_ a smal! de- cline. In the afternoon the market was very ac- tive, the short sales being enormous in volume. Stocks closed very firm at the following quota- tions:—Virginia ¢’s, 943 a 95; Missouri 6's, 813 a 82; Canton, 20} a 21; Cumberland Coal preferred, 15} 916); Pacific Mail Steamship, 94a}; New York Central, 743 a }; Erie, 93a 3; Hudson River, 39} a 4; Harlem, 9 8 }; do. preferred, 34 a 3; Reading, 42} 8 2; Michigan Central, 40) a }; Michigan South- ern and Northern Indiana, 83.24; do. gneranteed, 174 8 26; Panama, 163} a 3; Illinois Central, 61 a3; Galena and Chicago, 59} a}; Cleveland and Tule- @o, 203 a §; Chieago and Rock Island, 643 a }.
