Dismiss SRD Suit Filed Adams; Hicks And Commissioners Seek Dismissal Three motions to dismiss were filed today in the State Road Board’s suit to recov- er ‘Keys’ land deeded to Monroe County. On Oct. 11, the SRD began a suit against the county commissioners, the commissioners of the Overseas Road and Toll Bridge District, and commisson, and C. G, Hicks, sec- retary of the toll commission. Attorneys Act Wiliam V. Albury, Julius F. Stone. Jr., and. William R. Neb- lett, attorneys, filed a dismissal motion for the toll district com- missioners aad Hicks. Paul Sawyer, attorney, filed two dismissal motions — one for Ad- ams and one for the county com- missioners. The motion for Adams said that Adams was an improper and un- necessary party to the proceed- ings. The dismissal motions for the county commissoners and for the toll district commissioners were identical. Grounds For Request These motions asked the Circuit Court to dismiss the suit on the grounds: ‘ That there was a lack of juris- diction; that Florida laws barred the SRD from recovery; that the SRD is an “intermeddler’”’ and has no authority to bring the action; that the SRD attorneys — George Dayton and William J. Castagna — had no authority to sign the bill of complaint; that the complaint fails to state a cause for the ac- tion. The Overseas Road and Toll Bridge recently deeded more than 700 acres of choice Keys’ land to Monroe County. The SRD contends the toll dis- trict’s action was illegal. West Botary Club's loan fund for Mon- roe County college students will-be in operation by Sep- tember 1955. The club, at its regular luncheon meeting at the La Concha Hotel yesterday, voted to accept the re- commendations of the scholarship committee with two minor chang- es. The recommendations. stipulate that funds be loaned only to bona fide residents of Monroe County who are graduates of an accredit- ed high school in the county, Grade Requirements Applicants must have sufficient college credits to be of junior class level or better and have a scholas- tie average of C or better. They must also be enrolled in a college or institution of higher learning in the state of Florida. The loans are to be repaid after graduation in installments over a period of years. The club yoted to finance the loan fund for the first year by vol- untary contributions from the girl was reported earlier in the evening. Towner’s objections to the Proposed Meach- am Airport improvements have been squashed by the Chief of Naval Operations, today. The Key West Citizen learned Rear Adm. G. C. Towner, commander of the Naval Base, sought to kill a $130,000 Federal grant for the air- port because the proposed meet with his approval. The Chief of Naval Op- erations sent a dispatch to the Naval Base here last night, saying that the Chief of Naval Operations had no objections to the proposed improvement plans. Capt. C. L. Murphy, public in- formation officer and chief of staff to Towner, today admitted to The Citizen that he had received a di Patch covering the Meacham sit- uation. No Release “But I am not releasing any- thing,” he ‘added. Bearing out The Citizen’s infor- | mation that the Chief of Naval Op- erations rejected Towner’s protest was an Associated Press dispatch from Washington which quoted the Navy there as saying it had not objected “‘officially” to Meacham improvements, The use panel of the Civl Aero- nautics Authority now has the-Mea- cham situation under study and is expected to render a decision with- in a week or 10 days. Expansion Pains The county plans to pave and ex- tend the east - west runway. Towner objects to this plan, say- ing it would bring air traffie from Boca Chica Naval Air Station and Meacham Airport into conflict. Towner wrote the Chef of Naval Operations and recommended that the CNO ask the CAA to kill the $130,000 the CAA granted Monroe County to help finance the airport improvements. In another move to block the pro- posed Meacham improvements, Towner is holding up deeding 17.1 acres of land at the airport to the county. Towner’s Stand As part of the improvement pro- gram, the county asked Towner to recommend the land transfer to Washington. Towner, according to county offi- cials, has not given the county an answer either way. The county has offered to spend money to help re-locate U. S. 1 around Boca Chica to make way ol expansion of the Naval Air Sta- mn. The county also has appropriated funds to install a direct telephone line between Boca Chica and Mea- cham as a safety measure for land ings and take offs at the two fields.
