Members present: Commissioners; King Mullins, Shellman and Nelson. Commissioner Shellman moved that the whole Board be appointed a committee to examine the state road running north from Deer River across the big bog, the motion was seconded by Commis- sioner King and carried by unanimous vote. Commissioner Shellman moved that the chairman appoint a committee of three to examine roads in the Township of Balsam, for the opening of which, petitions are filed in the office of the county auditor. The motion was second- ed by Commissioner King and carried by unanimous vote. Chairman Mullins appointed Commis- sioners Shellman, O’Brien and Nelson as such committee. A communication from Attorney Frank F. Price requesting the board to fix a date when a committee of this board would meet a committee of the Board of County Commissioners of Koochich- ing county at International Falls for the purpose of making a settlement be- tween the two counties, was presented and read by the auditor. June 16th, 1911, was fixed as the date for said meeting. Upon motion by Commissioner King seconded by Commissioner Nelson the county auditor was instructed to adver- | | | pasta ar the the the ed that the sum of $300.00 be and same is hereby appropriated from County Road and Bridge Fund to Town of Marcell to aid said Town in the construction of a bridge across Rice river in said Town. The motion to adopt said resolution was seconded by Commissioner ~ rien and carried by unanimous vote. It being the time set for hearing up- on the application of Charles M. John- son for a license to sell intoxicating li- quors at Snow Ball in the Town of Greenway, said application was then taken under consideration. Commissioner Nelson moved that said pplication be granted. Commissioner Shellman moved said application be rejected. Commissioner O’Brien moved that the hearing upon said application be con- tinued to the afternoon session of the board. Commissioner King seconded Commis. sioner Nelson’s motion to grant the ap- plication and upon roll call the vote was as follows: Yea: Commissioners King and Nelson. Nay: Commissioners Mullins, Shellman Commissioner O’Brien not voting. It being the time set for hearing up- on the application of Archie Caron for license to sell intoxicating liquors at Snow Ball in the Town of Greenway, said application was then taken under consideration. Commissioner Shellman that moved that said application be rejected, the motion was seconded by Commis- sioner O’Brien and carried by unanimous vote. Commissioner King moved that the chairman appoint a committee of three to examine county road No. 79 beginn- ing at the northeast corner of section 36, township 55, Range 24, and ending at the northeast corner of section 31, Township 55, Range 23. The motion was seconded by Commissioner Mullins and carried by unanimous vote. Commision- ers Shellman, O’Brien and Mullins were appointed as such committee. The bids for the construction of a road Township 150, Range 28 and 5@ Range 29 were then opened read, the bids being as follows: A. C. Anderson for the construction of sections A, B, C, D and Station 1/the county auditor was of Section E, for the sum of $566.00. Henry Olson to complete the entire piece of wo for the sum of $1,100.00. Upon motion of Commissioner. Shell- man, seconded by Commissioner Nelson, said bids were rejected and the county auditor was instructed to re-advertise for new bids. Commissioner O’Brien arrived at this time. The bids for the construction of a bridge across the Bigfork river in sec- tion 7, Township 148, Range 26, were then opened and read, being as_ fol- lows: Hennepin Bridge Company for a steel bridge for the sum of $2,400.00. Lander Larson to complete said bridge March Ist, 1912, for $1,550, or October Ist, 1911, at $1,900.00. Bert Caldwell for the sum of $950.00. Francis Caldwell for the sum of $1,- 025.00. L. E. Hunter for the sum of $1,385.00 if completed in the summer or $1,175.00 if completed in the winter. Oslund & Anderson for the sum of 00 if completed in the summer 249 if completed in the winter. Wm. Hulbert for the sum of $1,850. Wm. J. Ibbotson to construct a float- ing bridge for the sum of $450.00. Commissioner Nelson moved that all bids be rejected. The motion was sec- onded by Commissioner Shellman and upon roll call was carried by the follow. ing vote: Yea: Commissioners Nelson, Shellman, O’Brien and Mullins. Nay: Commissioner King. A petition was pre¥ented for the es- tablishment of a highway beginning at the northwest corner of section 6, Township 55, Range 23, and running thence south on town line four miles to the southwest corner of section 19, Township Range 23. The petition appearing reasonable upon its face Com- missioner King moved that a hearing be had upon said petition at the county court house in Grand Rapids on Wednes day the 19th day of July, 1911, at 10 o'clock a. m., that Commissioners Nelsor Mullins and King be a committee to examine the proposed route of said road, that said committee meet at the point of beginning of said route on Tuesday the 18th day of July, 1911, at 10 o'clock a. m. for the purpose of ex- amining said route and that said com- mittee make report to this board at the time set for hearing upon said peti- tion. The motion was seconded by Com- missioner Shellman and carried by unan- imous vote. Commissioner King moved the adop- tion of the following resolution; Resolv- 24| missioners of Itasca County, Minnesota, that the road hereinafter described to- wit: beginning at the Village of Deer River, Township 145, Range 25, and running thence in a westerly direction parallel with and on the north side of the right of way of the Great Northern Railway to the point where said right of way intersects the Cass county line, and the same is hereby designated as state road for the purpose of having the same constructed or improved in accordance with the law. The motion was seconded by Commis- sioner O’Brien and carried by the fol- lowing vote: Yea: Commissioners King, O’Brien and Nelson. Commissioner Shellman not voting. Commissioner King moved that the County Surveyor be instructed to make an examination of the state road be- tween Deer River and Cohasset and pre- pare plans and specifications for neces- sary ditches upon said road. The motion was seconded by Commis- Mullins, and | sioner Nelson and carried by unanimous vote. Upon motion of Commissioner O’Brien instructed to advertise for bids for the construction of ditches on state road between Cohas- set and Deer River, all bids to be for a certain price per cubic yard. Said ditches to be constructed according to specifications prepared by the county surveyor. An adjournment was then taken until one o'clock p. m. Pursuant to adjournment the again met at one o'clock p. m. All members of the board present. A petition was presented for the es- tablishment of a highway beginning at one-eighth stake, eighty rods east of north€ast corner of section four, town- ship number fifty-six, range twenty- four, on north line of said township, and running thence west on said town line for a distance of one and one. half miles, to one-eighth stake, eighty rods west of the northwest corner of section four, township fifty-six, range twenty-four and to be connected with othe¥ roads as follows: with the Suck- er Brook road, af the one-eighth stake, eighty rods, east of the northeast cor- ner of section four, township fifty-six, range twenty-four, on north line of said township, and to be four rods in width. The petition appearing reasonable up- on its face Commissioner King moved that a hearing be had upon said petition at the county court house in Grand Rapids on Wednesday the 19th day of July, 1911, at 10 o'clock a. m. that Com- missioners Shellman, Nelson and King, be a committee to examine the proposed route of said road, that said committee meet at the point of beginning of said route on Thursday the 13th day of board July, 1911, at 10 o’clock a. m. for the purpose of examining said route and that said committee make report to this board at the time set for hearing upon said petition. The motion was seconded by Commissioner Nelson and carried by unanimous vote. Commissioner OBrien moved the adoption of the following resolution: Re- solved that the sum of $300.00 be and the same is hereby appropriated from the County Road and Bridge Fund to the Town of Harris to aid said Town in e construction of county road No. 48. The motion was seconded by Commis- sioner Shellman and carried by unani- mous vote. Commissioner O’Brien moved that the chairman apoint a committee of three to examine a part of Vermillion road in section 14, Township 55, Range 27. In the matter of the construction of a bridge across the Mississippi River in the Town of Blackberry, the fol- lowing petition was presented: In the Matter of Blackberry Bridge. To The Board of County Commissioners of Itasca County: The undersigned, the town board and town clerk of the Town of Black- berry, do respectfully represent to you: “That the town board has heretofore made its petition to you asking that the county appropriate one-half of the cost of a bridge across the Mis River in, that township, which peti was granted, and two of your number were duly appointed to act with the town board in lettimg the contract for the construction of the bridge; that the contract for the bridge has been | auy let to the lowest and best and most Y ple bidder, the Hennepin Bridge ;Company, in the sum of $14,000, which |bid the two commissioners and the | town board considered reasonable and the most favorable; that in the former | | petition it was stated that the estimated cost of the bridge was $10,000; that the members of the town board had no per- | sonal knowledge of the actual cost of | any such a bridge, and such statement was not meant to be the final cost of the bridge, and was an estimate which was given to the members of the board ! by a person upon whom they relied as | tu the probable cost of the bridge; that the statements contained in the former petition are referred to and made a part of this petition; that the town has provided for one-half of the cost of a bridge the construction of which will require the expenditure of $14,000. A petition was presented for the es- tablishment of a highway beginning at the quarter post between sections 22 and 27, Township 55, Range 27, and running thence one mile east. Commis- sioner O’Brien moved that a hearing be had upon said petition at the county court house in the Village of Grand Rapids on Wednesday the 19th day of July, 1911, at 10 o’clock a. m., that Com- missioners Nelson, Shellman and O’Brien be a committee to examine the proposed route of said road, that said committee meet at the point of beginning of said route on Friday the 14th day of July, 1911, at 11 o’clock a. m. for the purpose of examining said route and that said committee make report to this board at the time set for hearing upon said petition. The motion was seconded by Commis- sioner Shellman and carried by unani- mous vote. A. petition was presented for the es- tablishment of a highway beginning at the southeast corner of township 54, Range 24 and running thence west on Town line between said Township and Township 53, Range 24, to the point where said Town line intersects the Mis- sississippi river, and to be connected with other roads, Commissioner O’Brien }| moved that a hearing be had upon said Petition, at the court house in the Vil- lage of Grand Rapids on Wednesday the 19th day of July, 1911, at 10 o'clock a. m., that Commissioners Nelson, Mullins, and O’Brien, be a committee to examine the proposed route of said road, that said committee meet at the point of beginning of said route on Wednesday the 12th day of July, 1911, at 10 o’clock a m. for the purpose of examining said route and that said committee make report to this board at the time set for hearing upon said petition. The mo- tion was seconded by Commissioner Nel- son and carried by unanimous vote. A petition was presented for the es- tablishment of a highway beginning at the northeast corner of the southeast quarter of section four in town 144, range 25, and running thence north on and along the section line to a potet where the section line, between sec. tions 33 and 34 in township 145, range 25, intersect with the Deer River and Ball Club road and to be connected with other roads. Commissioner Shell- man moved that a hearing be had upon said petition at the court house in the Village of Grand Rapids on Wednesday the 19th day of July, 1911, at 10 o’clock, a. m., that Commissioners King, Mul- lins and Nelson be a committee to ex- amine the proposed route of said road, that said committee meet at the point of beginning of said route on Monday the 17th day of July, 1911, at 10 o'clock a. m., for the purpose of exam- ining said route and that said commit- tee make report to this board at the time set for hearing upon said petition. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. It being the time set for hearing upon the petition for the establishment of county road No. 99, the committee ap- pointed to examine the route of said road filed the following report: To the Board of County Commissioners of the County of Itasca, Minnesota: The undersigned committee appointed by you to examine the proposed route of a highway, as stated in the petition referred to in your order of appoint. ment made on the 4th day of May, 1911, would respectfully report that we met at the time and place designated in your said order and proceeded to ex- amine the highway proposed to be es- tablished: viz; Beginning at a point on the range line between township 55, range 24, and 55, range 25, 1930 feet south of the NE corner of section 1, township 55, range 25, and running thence south, 25 de- grees, 15 minutes, west, 862 feet, thence south, 69 degrees 49 minutes west 427 feet, thence south 33 degrees, 43 min- ues west, 933.8 feet, thence south 4 degrees, 54 minutes east, 394.5 feet, thence south 23 degrees 38 miuntes west, 469 feet, hence south 5 degrees, 34 min- utes east, 928 feet, thence south 33 degrees, 33 minutes east, 278 feet, thence south 60 degrees, 25 minutes east, 481.5 feet, thence south 42 degrees, 52 minutes east, 1193.5 feet to the range line between section 7, township 55, range 24, and section 12, township 55, range 25, said point being 1125 feet north of the quarter post between said sections. The undersigned committee appointed by you to examine the proposed route of @ highway, as stated in the petition re- ferred to in your order of appointment made on the 4th day of April, 1911, would respectfully report that we met at the time and place designated in your said order, and proceeded to exam- ine the highway proposed to be estab- j lished, viz: Beginning at the northeast corner of the northwest quarter of section two, in township 146, of range 26, and running south along the quarter line in said sec- tion to the northeast corner of south- east quarter of the southwest quarter of said section; therice east to the north- east corner of the southeast quarter of j the southeast quarter of said section two, thence south on section line to the northeast corner of section fourteen in said township; thence east along. sec. tion lint to the northeast corner of the northwest quarter of section thirteen in said township; thence south to the northeast corner of the southeast quar- ter of northwest quarter of said sec- tion; thence east to the northeast cor- ner of the southwest quarter of the northeast quarter of said section thence south to the northeast corner of the northwest quarter of the southeast quar- ter of said section thirteen; thence east to the northeast corner of the foutheast quarter of said section thir- teen, thente south on town line to the northeast corner of section twenty- four in said township 146 of range 26, and to be connected with other roads ; a8 follows: at the southern terminus of said above described proposed road and terminating at the northeast corner of section twenty-four, township 146, of range 26, and to be four (4) rods in width. Beginning at a point in the SW% of NW¥% section 34, township No. 55 range No. 27, 4th P. M. and running thence in a southwest direction to the east and west one-fourth line, thence west on \4 section line to the Third Guide Mer- idian or county line, to the % post on the west side of section No. 33, thence north on range line to intersect with the Cass county road. And do hereby by the opinion of a majority of said committee recommend that the prayer of the said petitioners be granted. Given under our hands this 8th day of June, 1911. ANDY NELSON, M. O'BRIEN. The undersigned committee appcinted by you to examine the proposed route of a highway, as stated in the petition referred to in your order »f xppoint- ment made on the 4th day of April, 1911 would respectfully report that we inet at the time and place designated in your order, and proceeded to #xamine the highway proposed to be estab!ished viz: Beginning at the quarter post on the west side of section 32, township 56, range 23, and running thence east on hed quarter line across said section 32, to the quarter post on the east side of said section 33, thence south on section line between sections 32 and 33 of said township to the southeast corner of said section 32, thence east on town fine between townships 55 and 56 of range 23, to the quarter post on the south side of section 33, of township 56, range 23. The following depository bonds were approved by unanimous vote, upon mo- tion of Commissioner O’Brien, seconded by Commissioner Shellman. First National Bank of Deer with the United States Fidelity Guaranty Company as surety sum of $25,000.00. The First State Bank of Grand Rap. ids with the Fidelity and Deposit Com- pany of Maryland; as surety in the sum of $5,000.00. The First State Bank of Grand Rapids with the American Bonding Company of Baltimore as surety in the sum of $5,000. The First State Bank of Grand Rapids with the National Surety Company of New York as surety in the sum of $5,000.00. The First National Bank of Grand Rapids with the National Surety Com- River and in the pany of New York as surety in the sum of $10,000.00. It being the time set for hearing up- on the petition for the establishment of County Ditch No. 2, the same was taken under consideration. John A. Brown the engineer appointed by the board to make the survey of said ditch was present, also L, W. Huntley and F. A. Johnson, two of the viewers ap- pointed by the. board in the matter of the establishment of said ditch, were present. Upon motion of Commissioner O'Brien seconded by Commissioner Shell- man the following order was adopted by unanimous vote. State of Minnesota, ss. In the Matter of the Petition of E. A. Kremer and Others, For a Public Ditch in the County of Itasca, State of Minnesota, Designated and Num. bered as County Ditch No. 2. The above entitled matter came on duly to be heard by and before the County Board of the County of Itasca, State of Minnesota, at a special meet. ing of said board duly called for the purpose of hearing and considering the petition for said ditch in the apove en- titled matter on the 8th day of June, A. D. 1911, at 2 o’clock p. m. of said day and it appearing by proper evidence that due notice had been given of the pendency of said petition and of said time for hearing thereon, and that John A. Brown the Civil Engineer appointed by this board to survey the route of saic ditch, has completed his work and du- ty filed his report thereon in the office of county auditor of said county, and that the viewers appointed by said board to view and report upon said work have duly completed their labors and made! and filed their report in due form of law in the office of said county au- ditor, the said county board did, at the time above specified, proceed to hear said petition and said viewer's report thereon; and said board having duly considered said petition and heard all the parties interested for or against the construction of said ditch and all other matters pertaining thereto, find as follows, to-wit; First: That the said civil engineer has completed his work and made and filed his report thereon in all respects according to law. Second: That the viewers appointed herein have duly completed their labors and have made and filed their report thereon according to law. Third: That the estimated benefits to be derived from the construction of said work are greater than its total cost, in- cluding damages awarded. Fourth: That the damages and bene- fits arising from the construction of said ditch have been fully awarded and assessed, and that said work will be of public utility and promote the public health and that said reports of said engineer and viewers are complete and correct. Fifth: That notice of this hearing of said petition and of said viewers’ re- Port and said engineer's report has been County of Itasca, duly given, published and posted and mailed as by law required, and that proofs of said service of said notice have been duly made and filed in office of the county auditor of said county, and that all other proceedings in the matter have been made and tak- en in accordance with the provisions of law. The following petition was then pre- sented: Petition for the Separation of Certain Unplatted Agricultural Lands from the Village of Warba. To the Board of County Commissioners of Itasca County, Minnesota. I, the undersigned, being the owner of the west half of northeast quarter of section 29, and the northwest quarter pf northeast quarter of section 21, im township 54, range 23, do hereby petition your honorable body for an order de- taching said land above described from the Village of Warba. Whereas, on the 8th day of June, 191 a) petition was filed in the office of the county auditor of Itasca County, Min- nesota, signed by the owners of the lands hereinafter described praying that an order be made by the Board of Conuty Commissioners of Itasca Coun- ty, Minnesota, detaching said lands from the Village of Warba. The tracts ot land included in said petition are de- scribed as follows, to-wit; The west half of northeast quarter of section 29, and the northwest quarter of northeast quarter of section 21, in township 54, range 23, for the following reasons, to- wit: That said lands are unplatted lands containing more than 80 acres occupi- ed and used solely for agricultural pur- poses and that the same is so condi- tioned as not properly to be subjected to village government. It is therefore ordered that said peti- tion be heard at a meeting of this board to be held at the county court house in the village of Grand Rapids in said county on Monday the 10th day of July, 1911, at 10 o’clock a. m., at which time and place this board will hear all persons interested for and against the granting of said petition. Commissioner Shellman moved adoption of the following resolufion: Whereas on the 4th day of May, 1911, by resolution duly adopted at a meet- ing of the Board of County Commission- ers held on said day the sum of $500 was appropriated from the county road and bridge fund to the Town of Balsam to aid said town in the construction of a road extending from Prairie river read and connecting with the Bovey read in said town. Now therefore be it resolved thei said the resolution be amended so as to pro- vide that one half of said appropriation |be expended upon said road and that the other half be expended upon the so-called Schumaker road on the range line between townships 58, range 23, and 58-24. The motion was seconded by Commissioner Nelson and carried by unanimous vote. The motion was seconded by Commissioner Shellman and carried by unanimous vote. The matter of the hearing upon the application of Frank Payne for license to sell intoxicating liquors at Ball Club was taken up. Commissioner O’Brien moved that said application be rejected. The motion was seconded by Commissioner Shellman and carried by the following vote. Yea: Commissioners O’Brien, Shellman and Mullins. Commissioners Nelson and King not present or voting. The hearing upon the petition of the establishment of county road No. 8e was continued to the next meeting. A petition was presented for the sur- vey of section and property lines of sections 7 and 8, township 150, range 28. Upon motion said petition was laid over to the next meeting. It being the time set for hearing upon the petition for the survey of section 19, township 56, range 26, the same was then taken under consideration. Com- missioner O’Brien moved that said pe- tition be granted and that John A.
