DERN BEING SUED ONBANK PAYMENT District National Depositor Seeks Return of Half of $750,000 Paid. Pollowing a precedent laid down last week in the Commercial National Rank case, a depositor in the Dis- trict National Bank filed suit in Dis- trict Supreme Court vesterday to re- eover half of more than $750,000 paid br the bank to Secretary of War Dern as trustee of the Philippine Islands Gold Standard Fund. The United States Court of Ap- peals for the District decided Satur- day that, in the absence of special statutory authority, officials of quasi- governmental agencies could not de- mand security for their deposits in national banks and must stand on | the same basis as general depositors | after insolvency. The suit against Secretary Dern was filed by Hugo Herfurth, jr.. 1362 Kennedy street. who had $4.200 on deposit with the Distriet National Bank when it was declared insolvent March 6, 1933, He savs the cabinet | officer demanded security for the de- posit and was paid in full after the bank closed. General depositors have received | enly 50 per cent of their deposits, and | Herfurth demands that Dern be com- pelled to refund all he received in excess of that percentage.
