It was disclosed today that the National Association of | Broadcasters has decided to seek disso- lution of the society under the anti- | trust laws. The music men say they| would welcome a suit to test the legality of their organization. Ever since last September, when new | contracts were signed increasing the | amount broadcasters are to pay the so- | elety from $960,000 to a sum expected to range between $1,300,000 and $2,000,~ 000 this vear, the two have been at loggerheads. Both Sides Insistent. The broadcasters, contending their business could not carry the load, have been insistent in their demand for a reduction in the fees, while the soclety, retaliating that broadcasting has con- siderably lowered the income from mu- sic distribution by other means, has been just as insistent that the scale be in_the opposite direction. Under the new contract, broadcasters pay a fixed annual fee for music used | for sustaining programs in addition to | 3 per cent the first year, 4 per cent the second, and 5 per cent the third of the | income from commercial programs, less | only the 15 per cent paid to advertising agencies. After that time new percent- | ages are to be set—lower, say the broad- casters; higher, says the society. The situation came to a head in a recent conference between a committee of the National Association of Broad- casters and E. C. Mills, general man- ager of the society. Situation Unclarified. The meeting adjourned with the so- clety declaring that only an upward rate revision would be considered and the broadcasters asserting they would take steps looking toward a dissolution suit. Later correspondence between the two groups has not clarified the situa- | tion. Meanwhile N. A. B. has organized the | radio program foundation to act as a | copyright clearing house mainly for broadcasting purposes. The object is to create a catalogue of music and other material for the use of the broadcasters and to make them independent of the soclety. P, REPEAL BILL SIGNED Pinchot Approves Election of 15 Delegates to State Convention. Harrisburg, Pa, May 4 (#).—Gov. Pinchot yesterday signed the bill DI’O-I viding for a State convention to act on the repeal of the eighteenth amend- ment. It provides for the election of 15 delegates at large. The Governor also signed the bill for the control of manufacture and sale of beer, over which there was a long fight in the Legislature. He announced ne would sign on Friday the bill levying a tax of $1.24 a barrel, or half a cent & bottle, on 3.2 beverages.
