BIFTS FOR RELIEF | HELD NOT EXPENSE I. C. C. Rules Contributions of Utilities Must Be Charged to Profit and Loss. By the Associated Press. The Interstate Commerce Commission today held that a $75,000 contribution | of the New York Telephone Co. to the emergency unemployment relief fund of New York City should be charged to profit and loss and not to operating ex- penses. The telephone company last Winter made a contribution to the New York Relief Committee and charged it against operating expenses on which telephone rates are based. ‘The commission instituted an inquiry to determine the proper accounting method. It called attention of State commissions ¥nd all carriers subject to | Federal jumisdiction to the prcceeding. Ordered Accounting Change. The New York Public Service Com- mission also investigated, and on March required the telephone company to transfer the charge from operating ex- pense to surplus. The New York State order covered donations from 1929 to 1932, inclusive. The telephone company contended its contribution shou!d be charged to oper- ating expenses, because if no unemploy- ment relief were provided the general depression would have had a greater unfavorable effect on the business of the company and might have led to destruction of its property. Such con- tributions and donaticns also, it was contended. were made for the general benefit and advantage of the company, even though no definite consideration was received “Upon analysis.” said the commission | report, “it is quite evident that the! contributicn in issue had only the most indirect and remote relation to the wel fare of the respondent and its propert business and employes, and only such relation as might be traced in the case of mest contributions for general chari- table cr social welfare purposes. Responsibility Not Same. “Nor has respondent the responsibility of an individual citizen with reference al community welfare. It has the status of an artificial person, its powers and duties are confined to those conferred or imposed upgn it by its charter and these do not intlude the festering of the general welfare of the community. “When respondent makes contribu- it for this general purpose and ) in effect exacting or attempting to exact these contribu- tions from the users of its telephone service. “It is their right and not the right of the respondent to decide what con- tributions of this character they shall make. Nor has the respondent any powers of taxation. If contributions in sufficient amount are not made volun- tion it is through the established agen- cies of Government that the taxation | should be imposed and not through | telephome companies or other public utilit in the ise of expense for service furnished.” Ignored in Rate Cases. In the District the Public Utilities Commission _hes ruled that contribu- tions by public utilities to the Com- munity Chest or similar charitable or- ganizations may be charged to operat- ing expenses for bookkeeping purposes, but th ey will not be considered as operating expences in rate cases. The effect of this is that a contri- bution may be made by vote of the board of directors. If it were neces- sary to charge the contributions to profit and loss, probably a vote of the stockholders would have to be taken be- | fore the contribution could be made. 1 NEW TAXES FORESEEN, AT WINTER SESSION Charges Cruelty ' FAMOUS SWIMMER SEEKS DIVORCE FROM BROKER. BRIDGEPORT, Conn., September 30. —Charging her husband with intoler- able cruelty since the day of their mar- riage two years ago, Helen Meany Balfe, internationally known diver, petitioned for a divorce yesterday from Henry H. Balfe, New York food broker. The former national and Olympic champion also asked she be allowed to resume her maiden name. Miss Meany married Balfe September 26, 1930, after dominating the ranks of American woman drivers for more than 10 years. She is the only woman to have competed in three Olympics for the United States. During her athletic career she won 16 national diving championships and & member of the Olympic team in | 1920, 1924 and 1928. In 1928, the year she won the Olympic low board diving champlonship, she went to Japan to give exhibitions. The Balfes have no children. MONTGOMERY RESIDENT, ILL SEVEN YEARS, DIES Lewis Bell King Will Be Buried Tomorrow From Clarksburg Methodist Church. Special Dispatch to The Star. CLARKSBURG, Md,, September 30.— Lewis Bell King, a well known resident of this county, died at his home near here late yesterday evening after an ill- ness of seven years due to paralysis. He was 72 years old and a lifelong resi- dent of this county. He is survived by his widow, Mrs. Emma Hurley King, and the following children: Sherwood King, Mrs. Marian Williams, Mrs. Thomas Hammond Du- | vall and Miss Grace King, all of Wash- | ington, and Mrs. Albert R. Scott of | Damascus. He also is survived by the following brothers and sisters, James E. | King, H. Hicks King., Mrs. Evva Wal kins and Mrs. C. L. Watkins, all of this county. Roosevelt as Presi- dent In discussing the tax situation, Repre- sentative Rainey pointed out “the Gov- ernment is running behind at the rate of about $3,000,000 a day, indicating a deficit of about $900,000,000 during the current fiscal year.” “The revenue Secretary Mills said would be returned from the new legis- lation has not materialized,” Mr. Rainey said. “We have a choice of either a gen- eral manufacturers’ sales tax, with a low rate, or of increasing the present irritating and discriminatory taxes. I favor a general manufacturers’ sales tax.” Rainey supported the sales tax which was defeated last session. In discussing the Illinois political situation Mr. Rainey said, “the only part the Republicans are playing in the Illincis political game is for the election of Len Small, as governor. “Republican leaders there have given up the fight for Hoover,” he added. “Illinois also will elect Representative Dieterich (Democrat) over Senator Glenn (Republican) by about the same majority that Roosevelt will receive.
