The amended petition, which asks the appointment of receivers for the hotel, contains only general allegations of fraud, conclusions of fact and of Jaw, inferences and unwarranted assump- tions, the court was told. It also was alleged that the petition is so vague and indefinite. as not to advise the de- fendants of the nature of the case against them, and does not show any rights of the plaintiffs to maintain the suit. The allegation of adverse interest against the trustee under the mortgage is mere inference and assumption, it is claimed, and is unsupported by fact. Failure to serve notice on the trustees before filinz the suit was cited as a fatal defect in the amended bill, which is declared to have been filed improvi- dently and unseasonably.
