Colts, colored, which was carried to the United States Supreme Court from Police Court a year ago to determine | whether the defendant was entitled to | trial by jury, is scheduled for trial the | sccond time in the low court Thursday before a jury. Colts was arrested by Policeman Miles Znamenacek on O street southeast July, 1929, and Judge John P. McMahon sub- sequently refused the man's demand for jury trial, convicted him and sentenced him to 30 days in jail. Attorneys for | Colts took the case to the District Court of Appeals, where the Police Court judgment was reversed. The District realizing the cost of hearing similar cases before juries, as well as different charges which were affected by the rul- ing, asked the Supreme Court for a final decision. The tribunal on November 24, 1930, handed down an opinion in which the Appelate Court was upheld. ordered that another trial be given Colts in Police Court, and this time by a jury Today Attorney Louis Whitestone, counsel for Colts, filed a motion to quash the case, stating that the court | arraignment papers are illegal because ( they charge the man with more than one offense. Whitestone contends that the wording of the papers, which ac- cuses Colts of “driving recklessly, at an unreasonable speed, and without re- gard for life and property,” is too gen- eral. The attorney said that the charge in reckless driving cases has been made | more_specific since the Colt case origi- | nated. | Judge Ralph Given is expected to rule on the defense motion before the trial opens.
