MOUNT OLIVE, Ill, December The last journey of Mary (Mother) Jones, firebrand of unionism, ended as she willed in this little Southern Illi- nois mining community last night. The special car bearing the body of “Mother” Jones from _ Washington, D. C, arrived here shortly before |8 pm. Hundreds of persons, members | of labor organizations in Illinois, were | at the station when the train pulled |in. Some wept,. others bowed their heads in reverence, as the band played “Nearer, "My God, to Thee.” “The mother of organized labor,” as she was often called, will be buried in the Miners' Cemetery here next Monday near the graves of three Mount Olive miners who gave their lives for the cause of union labor in the Virden Mine riot 32 years ago. The pallbearers, miners who par- ticipated in the Virden riot, carried the casket to the Odd Fellows’ Temple, where it will lie in state until the funeral. Testing A new type airplane brake, Hudson recently made the 4899 flights at the Akron municipal airport. Federal control over broadcasting was attacked today in the Supreme Court. Two cases from Chicago challenged the Radio Commission sfithority to require stations to cease broadeasting or to re- duce power and change wave lengths. Congress directed the commission to zone the country and regulate broad- casting. Under this the commission ordered Clinton R. White, operating station CRW, at Chicago, to reduce power, and refused to renew the licenses j of stations WMBB and WOK, at Home- wood, near Chicago, operated by the American Bond and Mortgage Co. and by Trianon, Incorporated. ‘The stations, claiming property rights protected by the Constitution, challenged its authority, but the Federal District Court at Chicago sustained the com- mission. But the Circult Court of Ap- peals asked the Supreme Court for in- structions on various constitutional questions involved, Solicitor General Thacher, for the commission, contended it not only could exercise a regulatory power, but -could refuse to renew old licenses. Such action was deemed necessary to im- prove radio reception. Counsel for the broadcasters declared Congress had made no provision to com- pensate them for the property which the commission’s orders would destroy, and that the radio acts it had passed were therefore invalid.
