DENVER, June 10.—The State Su- me Court yesterday decreed that oward L. Royston, George J. Abshier end Ralpk E. Fleagle, members of the ng that held up tne First National Enk of Lamar, Colo, May 3, 1928, and killed four men, must hang for the murder of one of the victims, A. N. Parrish, president of the bank. Abshier, the bespectacled, quietest member of the gang, will be hanged « during the week of July 19, as will Royston. Fleagle, whose confession to participation in the robbery led to the conviction of all three men, will go to the gallows the week of July 12. The Supreme Court held that Fleagle had not been promised his life in return for the confession that im- plicated_his confederates. Jake Fleagle, brother of Ralph, and alleged leader of the bandit gang, which, in addition to the Lamar “job, was credited with numerous other bank robberies in Kansas and Oklahoma, is still being sought. SAN FRANCISCO, June 10.—Miss Marian Birney, 29, landscape artist, was day pending a preliminary hearing on grand theft charges preferred by her father, Dr. Bascom Birney, 74, who ac- cused his daughter of absconding to New York with $63,000 in bonds be- longing to him. Judge George Steiger, who previously had xed bail at $50,000, permitted Miss Birney to go free pending further action, following an explanation of her side of the case.
