By the Associated Press, VIENNA, March 27.—An accident and | suicide insurance policy taken out by Dr. Hermann (Ernst) Watzl of Cleve- land for his bigamous bride, Mrs. Mary McGranahan of that city, a few days be- | fore he shot her and then himself in a hotel here, was said by the insurance company to be void. | The company said it would not pay | the policy, which was made out to Mrs, | Eva Hovarth of Cleveland, mother of | Mrs. McGranahan, inasmuch as the | suicide clause was not operative for two years after the issuance of the policy and because, besides, Watzl procured the policy under the false name of Flassak. t was secured on the second day of their arrival here. By shooting himself shortly before midnight Sunday, when the premiums {on his own policy of $35,000 expired, Watzl is believed here to have assured collection of the amount by his wife and two daughters in Cleveland. Watzl, a prominent chemist, disap- peared last November while en route trom Cleveland to Philadelphia and was | rediscovered only after he had shot | himself and Mrs. McGranahan, whom | he had married, although neither had il; divorce, in a hotel room here Sun- ay. The bodies of Dr. Watzl and Mrs. McGranahan will be released today from the Legal Medical Institute for final disposal. Accerding to Watzl, sr., his son will be cremated in Vienna Saturday in the presence of his fam- ily. Later Mrs. McGranahan will be cremated at the same crematorium. Judge Dehy recently appointed Dr. ‘William O. P. Hulse, dean of the medi- cal school of Stanford University, and Dr. Langley Porter, dean of the medi- cal school of the University of Cali- fornia, to the board. A lengthy court contest waged by Mrs. McCormick against the brother and sis- ter resulted in Judge Dehy issuing an order dismissing the physician formerly in charge of Stanley McCormick. MONTGOMERY, Ala, March 27— In the operation of a municipal, airport a city is engaged in the performance of |a corporate function as distinguished from a governmental one and is liable for any damage resulting from or inci- dent to the negligent operation of the airport, the Alabama Court of Appeals has ruled. ‘The ruling is contained in an opinion by Justice James Rice in the appealed case of the City of Mobile and John R. Peavy vs. Willlam A. Lartigue, in which the high court affirmed judgment of the Mobile Circuit Court, where Lartigue obtained judgment against the city and Peavy as city engineer for $350 in his suit for damages.
