G THREATEN TO AL COLLEAGLE Question of Jurisdiction Is Cause of Tilt Between Chicago Jurists. By the Associated Press. CHICAGO, July 24.—Judge Frank Comerford of the Criminal Court told Judge John H. Lyle of Municipal Court vesterday that he might be forced to send the latter to jail for refusing to testify in the habeas corpus case of Police Lieut. Willlam McCarthy. A con- troversy over jurisdiction of the two courts was responsible. McCarthy was sentenced a week ago by Judge Lyle to 30 days for contempt after he had attempted to coach an- other officer on trial for false arrest of a group of boys. Judge Comerford granted McCarthy a writ of habeas corpus and subpenaed Judge Lyle to show cause why McCarthy, now acting ehief of detectives, should be held. “It seems that Judge Lyle forgets this s a courtroom and that Judge Lyle is forcing, not to say badgering, this court into sending him to jail,” Judge Com- erford said when Judge Lyle declined to testify. “This court directs you to answer as a layman would. You are not on a lecture phtform, and if you persist in this conduct I shall have to send you to jail.” Judge Lyle countered with the state- ment that the McCarthy case was still pending in his court. “Your statement that you will send me to jail for contempt of court for standing up for my opinion—why, you will just have to do it,” Judge Lyle said, adding that it would take physical force to get him into Judge Comerford's courtroom on Friday, when the hearing 1s scheduled to be resumed.
