Cunningham to Be Taken in Custody Under Supreme Court Order. David S. Barry, sergeant-at-arms of the Senate, is preparing to carry out next week the mandate of the Supreme Court ordering the arrest of Sheriff Thomas W. Cunningham of Philadel- phia in connection with the Senate in- vestigation of the election of William S. Vare of Pennsylvania. The mandate was mailed yesterday to the clerk of the Federal District Court at Phila- delphia. Under a Senate resolution, introduced by Senator King, Democrat, Utah, the sergeant-at-arms will be authorized to release Cunningham under bond of $1.- 000 for his appearance before the Sen- ate when wanted. During_ the investigation of the elec- tion of Vare as United States Senator, Cuningham twice appeared as a witness before the Senate committee and testi- fled he had contributed $50,000 to the State Republican organization for cam- paign purposes.
