GENEVA, Ill, April 26.—The grand Jury has decided not to indict Deputy Sheriff Roy Smith for the slaying dur- ing a dry raid of Mrs. Lillian De King, but it was reported to have been dead- locked for some hours yesterday over a grfiposnl to indict the dead woman's jusband, Joseph, on a liquor charge. Ten surprise witnesses were under- stood to have told of having bought liquor from De King at his Aurora home, and it was on this testimony that gome members of the jury favored an indictment. The majority, however, held that whether De King sold liquor was irrelevant, the investigation being to determine how his wife was killed and if her killing called for indictment. Husband Questioned. It was revealed that De King was asked by one juror if he did not con- sider himself to blame for his wife's + death; had he not been standing with his revolvers in plain sight when the ralders demanded to search his home he would not have been struck down from behind and his wife shot, he was advised. . One true bill was voted. It charged perjury against Eugene Boyd Fairchild, ¥hose affidavit of buying liquor at the De King home led to the raid. Fair- child told a coroner’s jury that he did not actually buy the liquor himself, as the affidavit asserted. A coroner's jury found that Mrs. De King had been shot by Deputy Sheriff Smith as she attempted to go to the side of her husband, who had been felled by a blow from Smith’s clubbed shotgun. One Ballot Taken. Several members of the grand jury yesterday were said to have voted to in- dict Smith, but the number was insuf- ficient. and only one ballot was taken. Members of Sheriff L. L. Urch's force ‘were busy today in search of the person who fired the shot that struck the au- fomobile of one of his deputies, Pearly Peck, at the Aurora race track. Peck was a member of the party that raided the De King home in search of evidence of dry law violation. The sheriff and State’s Attorney George D. Carbary believed the appar- ent attempt on Peck's life might have Tesulted from a fanatic’s desire to even up what he imagined was wrong to the De King family. All Kane County au- thorities were decided in their opinion that none of the De Kings had any- thing to do with the incident.
