PAYMENT SETTLES TT-YEAR RENT WAR Western Union Gives Rail- road Check for $1,741,000 to Terminate Court Fight. By the Associated Press. LOUISVILLE, Ky., March 28—A check for $1,741,000, given yesterday to the Louisville & Nashville Railroad Co. by the Western Union Tengraph Co., ended litigation of 17 years’ standing, believed to be unique and of unprece- dented proportions. The check is for rent claimed by the railroad for the telegraph company’s occupancy of its right of way with poles and wires dur- ing the controversy. ‘Announcement of the settlement came from general offices of the railroad here yesterday. The settlement was made in New York by Whitefoord R. Cole, presi- dent of the railroad; Newcomb Carlton, president of the telegraph company, and attorneys for both corporations. Case Involved $2,300,000. The check was paid in compromise and settlement of a judgment rendered by Judge A. M. J. Cochran of the Fed- eral Court of the Eastern District of Kentucky, which was appealed to the United States Circuit Court of Appeals at Cincinnati and argued there a year ago. Due to the death of a judge, the case was ordered up for new arguments, which were to have been heard April 11. The suit was brought by the Louisville & Nashville to recover for the Western Union’s use and occupation with its poles and wires of the railroad com- pany’s rights of way during the time ihe telegraph company was seeking to condemn the right to remain on the railroad company’s property., By the tlement, $2,300,000 in round numbers s allowed for rental, from which was ducted approximately $540,000, repre- sonting an admitted account held by the Western Union against the Louis- ville & Nashville for services and facili- ties rendered during the period of the controversy. The remainder is the amount for which the check referred to was given. The litigation was precipitated by the action of the Western Union in can- celing its contract with the L. & N. in 1912 and the filing of condemnation proceedings to acquire a right in per- petuity along the railroad company’s pmperuu ‘When the Western Union ihus canceled its contract it was noti- fied by the L. & N. to vacate its prop- erties. This it refused to do and ob- | tained injunctions restraining the rail- road from ejecting it. It was for the occupancy protected in these injunc- tions that the L. & N. filed suit which is now settled. Enter Into New Contract. The Western Union and the L. & N. last August entered into a contract un- der which the former’s poles were re- moved from the latter’s property md\ the telegraph company allowed to rent | attachment space for its wires on the poles of the railroad company. In the same contract provision was made for the telegraph company to furnish serv- ice to residents of some 500 of the rail- road's stations. ; An _indication of the magnitude of past litigation between the corporations is the fact that in condemnation and injunction suits there have been 44 ap- peals to the State and Federal nrpe]lnte (ourln seven of them being to preme Court of the United States. At Marshall Hall, Md,, in June, 1926, & young man, said to be transporting 10 pints of alleged liquor, was arrested by Prohibition nt B, N. Off Hains Point, as the vessel was nearing the dock, the arrested man crawled through a port hole and leaped into the water. He swam to shore and escaped arrest. Two weeks ago Spence was arrested on a warrant issued on Quinn’s affidavit and held for a preliminary hearing be- fore Turnage. Appearing as the Government's chief witness, Quinn declared when he faced Spence_ that although the young man resembled the one who escaped more than two years ago he was unable to identify him under oath.
